Consideraciones en torno a la normativa sobre los prestadores de servicios en línea y editoriales de prensa propendida por la nueva directiva europea sobre derechos de autor y derechos afines en el mercado único digital

On the 17th of May 2019 a new Directive concerning author’s rights and related rights in the digital environment was published in the Official Journal of the European Union. With the objective of rebalancing forces in the author’s rights’ market, this Directive bestows new responsibilities upon online service providers that grant access to contents uploaded by their own users. It also confers a new right to publishers of press publications over their press publications. Since it is probable that other legislative authorities intend to follow this initiative, it is pertinent to analyze its possible legal and economic effects. For this purpose, this article purports to make a comparison between the regulation prior to this Directive, and the changes the latter will implement in relation to online service providers and publishers of press publications. Observations regarding possible impacts on the market will also be presented. Finally, it will be concluded that although the Directive offers solutions for the protection of creative industries, it is possible that it also represents obstacles for the development of innovative business models on the Internet.El 17 de mayo de 2019 una nueva Directiva sobre derechos de autor y derechos conexos en el entorno digital fue publicada en el Diario Oficial de la Unión Europea. Con el objetivo de reequilibrar fuerzas en el mercado de derecho de autor, esta Directiva confiere nuevas responsabilidades a los prestadores de servicios en línea que brindan acceso a contenidos cargados por sus propios usuarios, así como un nuevo derecho a las editoriales de prensa sobre sus publicaciones. Dado que es probable que en otras jurisdicciones se pretenda seguir esta iniciativa, es pertinente efectuar un análisis sobre sus posibles efectos jurídicos y económicos. Para ello, en este artículo se propone realizar una comparación entre la regulación anterior a esta Directiva y los cambios que ella plantea en relación con los prestadores de servicios en línea y las editoriales de prensa. Asimismo, se traen a colación observaciones sobre los posibles impactos en el mercado. Al final se concluye que, si bien la Directiva ofrece soluciones para proteger industrias creativas, es posible que erija obstáculos para el desarrollo de modelos empresariales innovadores en internet
