Una reforma electoral para Costa Rica y su potencial de promover el desarrollo equitativo en todo el territorio nacional

The association Poder Ciudadano ¡Ya! Presented in 2016 a bill (#20127) to the Legislative Assembly of Costa Rica to adopt a proportional mixed system of election of Congress members with the belief that the proportional system per closed party list does not offer representation; thus, it prevents the legislative assembly from responding in a timely and effective manner to the contemporary challenges and demands of the citizens. The author goes even further and presents the hypothesis that the current proportional system with a provincial basis is also responsible for the unequal development between the urban center and the peripheral regions of the country. The author explores, from a systemic approach, the possible co-relation of the proportional model of election with the socio-economic lag of the coastal and rural areas. Specialized doctrine and comparative law allow the author to conclude that the adoption of the Proportional Mixed System has the potential to offer equal representation for the entire electorate, to bring the decision makers closer to the recipients of public policies, to generate legislative work that can produce an equitable impact in the entire territory and re-distribute power in accordance with the time and with what the citizenry demandsLa asociación Poder Ciudadano ¡Ya! presentó en 2016 un proyecto de ley (#20127) a la Asamblea Legislativa de Costa Rica para adoptar un sistema mixto proporcional de elección de diputados, con la convicción de que el sistema proporcional por lista cerrada partidaria no ofrece representatividad y, por ende, impide que la Asamblea Legislativa responda de manera oportuna y efectiva a los retos contemporáneos y a las demandas ciudadanas. La autora va más allá y expone la hipótesis de que el actual sistema proporcional con base provincial es también corresponsable del desarrollo desigual entre el centro urbano y las regiones periféricas del país. Desde un enfoque sistémico explora la posible correlación del modelo proporcional de elección con el retraso socioeconómico de las zonas rurales y costeras. La doctrina especializada y el derecho comparado le permiten concluir que la adopción del Sistema Mixto Proporcional tiene el potencial de ofrecer representatividad pareja para todo el electorado, de acercar los tomadores de decisiones a los receptores de la política pública, de generar un trabajo legislativo que produzca impacto equitativo en todo el territorio nacional, y de redistribuir el poder acorde con los tiempos y con lo que la ciudadanía demand
