The limits of african neo-constitutionalism: reflections on constitutional distortions in thefrancophone states of black africa

This paper analyses and puts into perspective certain manifestations of crisis and distortions of the constitutional orders that operate in African neo-constitutionalism: First, a crisis of electoral democracy, followed by a crisis of normativity or supremacy of the constitution and finally a crisis of political and jurisdictional checks mechanisms. These distortions are dependent of the structural constraints and real factors in the African political process. This paper argues that these abnormalities can be grasped, both legally and politically, as limits of "liberal constitutionalism" in Africa and interpreted as transitory phenomena of a maturing process towards authentically African constitutionalism, which aspires to more effectiveness but removed from the authoritarianism of the past. The choice of the geographical scope of this study on African neo-constitutionalism, which is justified by arguments of the community of language and similarities in political and constitutional regimes, targets the French-speaking States of West Africa and the former Belgian colonies of Central Africa: Benin, Cameroon, Gabon, Central African Republic, Togo, Mali, Burkina Faso, Ivory Coast, Senegal, Niger, Congo Rd, Congo Brazzaville, Rwanda and Burundi. Exclusion made from other French territories of Black Africa: Djibouti and Comoros. Madagascar is not Black Africa.Este artículo analiza y pone en perspectiva ciertas manifestaciones de crisis y distorsiones de los órdenes constitucionales que discurren en el nuevo constitucionalismo africano: Primero, una crisis de la democracia electoral, seguida de una crisis de normatividad o supremacía de la constitución y finalmente una crisis de los contrapoderes políticos y jurisdiccionales. Estas distorsiones son consecuencias de algunas condiciones estructurales y de factores reales que concurren en el ejercicio del poder político. El artículo sugiere que estas anomalías pueden ser consideradas, en los planos jurídico y político, como los límites del "constitucionalismo liberal" en África y ser interpretadas como fenómenos transitorios de un proceso de maduración hacia un constitucionalismo auténticamente africana, que aspira a más efectividad, pero lejos del autoritarismo de antaño. La elección del ámbito geográfico de este estudio del neoconstitucionalismo africano se justifica por los argumentos de la comunidad lingüística y las similitudes en cuanto a modelos de los regímenes políticos y constitucionales. Se trata de los Estados de habla francesa de África occidental y a las ex colonias belgas de África Central: Benín, Camerún, Gabón, República Centroafricana, Togo, Mali, Burkina Faso, Costa de Marfil, Senegal, Níger, Congo Rd, Congo Brazzaville, Ruanda y Burundi. Exclusión hecha de otros territorios franceses de África negra: Djibouti y Comores. Madagascar no es África Negra
