El Delegado de Protección de Datos en la Administración local.

As of January 1, 2019, there are a total of 8,124 municipalities in the Kingdom of Spain which, in their capacity as Local Public Administration, must have the figure of a Data Protection Officer since the delivery in force of the European Data Protection Regulation - RGPD- last May 25, 2018. This work develops the considerations of a public employee on the figure of the Data Protection Officer in the scope of a City Council, for this, after analyzing the applicable legal system and the most relevant publications on the subject, we dare to formulate a definition of the Data Protection Officer in the Local Administration, we examine whether the scope of competence should be exercised exclusively by specialized public employees (career civil servants), their training and the special quality of independence and ethics applied to their figure. Finally, we will develop the functions of the Data Protection Officer in the Town Hall and his experience in a municipality of up to 20,000 inhabitants.A fecha 1 de enero de 2.019 existen en el Reino de España un total de 8.124 municipios 1 que, en su cualidad de Administración Pública Local, deben contar con la figura de un Delegado de Protección de Datos –DPD- desde la entrada en vigor del Reglamento Europeo de Protección de Datos –RGPD- el pasado 25 de mayo de 2.018. En el presente trabajo se vienen a desarrollar las consideraciones de un empleado público sobre la figura del DPD en el ámbito de un Ayuntamiento, para ello, tras analizar el ordenamiento jurídico aplicable y las publicaciones más relevantes aparecidas en la materia, nos atrevemos a formular una definición del Delegado de Protección de Datos en la Administración Local, examinamos también si el ámbito competencial asignado al mismo debe ser ejercido en exclusiva por empleados públicos especializados (funcionarios de carrera), cuál debe ser su formación y las especiales cualidades del DPD en materia de independencia y ética aplicables a su figura. Por último, desarrollaremos las funciones del Delegado de Protección de Datos en el Ayuntamiento y unas breves notas sobre la experiencia en un municipio de hasta 20.000 habitantes
