The statute of the religious confessions in the LOLR: towards a major guarantee of the right of religious freedom

The present work aims to highlight the relationship of necessity that exists between the individual and collective dimensions of religious freedom. Individual religious freedom requires for its full exercise that the State also adequately guarantees this right with respect to the confessions in which individuals are integrated as channels of realization of the first through their activities and structures. Certainly, the LOLR includes, in its second article, a wide catalog of rights that would remain without content if the collective facet of the religious phenomenon was not sufficiently recognized and guaranteed. In line with this, it addresses those aspects of the statute of religious confessions designed by the LOLR that have a more direct connection with the synergy between the individual and collective planes of the right of religious freedom, such as the requirements to access the Register of Religious Entities, the scope of the administrative action aimed at verifying the concurrence of those, the nature and effects of registration and, within the framework of the latter, the budgets and corollaries of a possible relationship of cooperation of the State with them.El presente trabajo tiene por objeto destacar la relación de necesariedad que existe entre las dimensiones individual y colectiva de la libertad religiosa. La libertad religiosa individual exige para su pleno ejercicio que el Estado también garantice adecuadamente este mismo derecho respecto de las confesiones en que los individuos se integran en cuanto cauces de realización del primero a través de sus actividades y estructuras. Ciertamente, la LOLR recoge, en su artículo segundo, un amplio catálogo de derechos que quedarían sin contenido si la faceta colectiva del fenómeno religioso no estuviera lo suficientemente reconocida y garantizada. En línea con ello, se abordan aquellos aspectos del estatuto de las confesiones religiosas diseñado por la LOLR que guardan una conexión más directa con la apuntada sinergia entre los planos individual y colectivo del derecho de libertad religiosa, tales como los requisitos para acceder al Registro de Entidades Religiosas, el alcance de la actuación administrativa dirigida a verificar la concurrencia de aquellos, la naturaleza y efectos de la inscripción y, en el marco de estos últimos, los presupuestos y corolarios de una eventual relación de cooperación del Estado con ellas
