La calificación del concurso de acreedores

The rating section opens with the purpose of analyzing the causes of insolvency, and discerning whether the debtor has acted guilty or not, and if so, debug the corresponding responsibilities by determining the persons responsible. The qualification is processed separately, has a common procedure and some procedural specialties. The most outstanding procedures will be the necessary report of the insolvency administration and the opinion, if any, issued by the Public Prosecutor. The hearing is given to the contest and is placed for allegations to people with legitimate interest, creditors, if applicable accomplices and also who could be affected by the qualification. The qualifying judgment will determine the contest as a fortuitous or guilty party, in the latter case, express the reasons that support this qualification, and also must rule on the effects of that conviction.La sección de calificación se abre con el objeto de analizar las causas de insolvencia, y discernir si el deudor ha actuado de un modo culpable o no, y en caso afirmativo depurar las responsabilidades correspondientes determinando las personas responsables. La calificación se tramita en pieza separada, cuenta con un procedimiento común y algunas especialidades procedimentales. Los trámites más destacados serán el necesario informe de la administración concursal y el dictamen, en su caso, emitido por el Ministerio Fiscal. Se da audiencia al concursado y se emplaza para alegaciones a las personas con interés legítimo, acreedores, en su caso, cómplices y además a quien pudiera resultar afectado por la calificación. La sentencia de calificación determinará el concurso como fortuito o culpable, en este último caso, expresara las causas que fundamenten esta calificación, y además deberá pronunciarse sobre los efectos de esa declaración de culpabilidad
