FAMILIES FORMED BY POLYAMORY: AN ANALYSIS ABOUT THE POSSIBILITY OF THEIR LEGAL RECOGNITION

Dissertação de Mestrado em Direito apresentada à Faculdade de DireitoThe thesis aims to illustrate the polyamorous relationships and the possibility of these relations being legally recognized as familiar entities in Brazil as in Portugal, since, currently, the individuals who intend to constitute a family under this form of family arrangement are not recognized by Brazilian and Portuguese legal systems. The study is carried out with greater focus on the legal systems of both countries. Initially, the study is made about a historical evolution of the family entities in the Western world and then it is observed that the institute of the family suffered great religious influences that dictated moral rules that persist until today. In this way, it would not be possible to establish a rationale about the possibility of legal recognition of polyamorous families without observing the transforming elements of Family Law in the course of time. The Family Law accompanies social transformations, so that from the reality of families as an indissoluble institution, monogamous and heterosexual to the current reality in which divorce and homoaffective relations are admitted, many were the elements legal and social issues that have helped in the necessary transformations of this branch of Law. Thus, the structural logic of this work is based on the premise that these elements of transformation, such as the principles of equality, freedom and affectivity, the plurality of families, the phenomenon of sacralism and the campaing against moral panics through the struggle promoted by social movements , are able to give legitimacy to the families formed by the polyamory, either in its polygamous or polyaffection form. Thus, since polyamorous families are protected by constitutional principles, there is no sense in their denial by means of infraconstitutional devices, in a way that deserves to be recognized these family entities both through the institution of marriage, and that of stable unions.O presente trabalho é dedicado à compreensão das relações poliamorosas e a possibilidade dessas relações serem reconhecidas juridicamente como entidades familiares tanto no Brasil, quanto em Portugal, uma vez que, atualmente, os indivíduos que pretendem constituir família sob essa forma de arranjo familiar estão à margem da proteção jurídica brasileira ou portuguesa. Dessa forma, notadamente, o estudo é realizado com enfoque nos ordenamentos jurídicos de ambos os países. Verifica-se, inicialmente, uma evolução histórica das entidades familiares no mundo ocidental, de maneira com que é possível alcançar que o instituto da família sofreu grandes influências religiosas que ditavam regras morais que perduram até hoje. Desse modo, não seria possível traçar um raciocínio acerca da possibilidade de reconhecimento jurídico das famílias poliamorosas sem que se observassem os elementos transformadores do Direito das Famílias no decorrer dos tempos. É certo, portanto, que o Direito das Famílias acompanha as transformações sociais, de maneira com que, da realidade das famílias como instituição indissolúvel, monogâmica e heterossexual até a realidade atual em que se admite o divórcio e as relações homoafetivas, muitos foram os elementos jurídicos e sociais que auxiliaram nas transformações necessárias desse ramo do Direito. Assim, a lógica estrutural deste trabalho parte da premissa de que esses elementos de transformação, tais como os princípios da igualdade, liberdade e afetividade, a pluralidade das famílias, o fenômeno da sacralização e o combate aos pânicos morais através da luta promovida por movimentos sociais, são capazes de dar legitimidade às famílias formadas pelo poliamor, seja em sua forma poligâmica ou poliafetiva. Dessa forma, sendo as famílias poliamorosas protegidas por princípios constitucionais, passa a não haver sentido a sua renegação por meio de dispositivos infraconstitucionais, de maneira com que merecem ser reconhecidas essas entidades familiares tanto através da instituição do casamento, quanto da das uniões estáveis/de facto
