THE (UN)SEIZABLE NATURE OF FAMILY RESIDENCES - CONSIDERATIONS ON LAW NO 13/2016 OF 23 MAY

Starting from this perspective, the research addresses the way seizure of assets is established, with emphasis on seizure of family residences. At this point, it's relevant to compare it with the Brazilian law in which family residences have absolute protection and are considered an unseizable asset. At the same time, an analysis will be conducted to determine whether the seizure of this asset threatens a constitutionally protected right, which also applies to the right to housing.Recently the Law No 13/2016 of 23 May has recognized the extremely importance that family residences have on the family stability and, therefore, has prevented them from being sold in the context of tax enforcement proceedings. However, the interpretation of Law No 13/2016 of 23 May has not been unanimous. Thus, in line with recent jurisprudence, the changes introduced by this Law and its scope will be studied. Finally, a brief analysis will be presented on the ad nutum suspension of the limitation period, which occurs whenever there is a legal impediment to the sale, and on the distortion to which the concept of seizure is subject to.-----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------Com a presente dissertação procuraremos refletir sobre a importância da casa de morada de família no Ordenamento Jurídico Português e sobre os meios processuais adotados, pelo nosso legislador, de forma a garantir a sua proteção. Partindo deste prisma, estudaremos o instituto da penhora, atribuindo particular atenção à penhora da casa de morada de família. Aqui, aproveitaremos para fazer um confronto com o direito brasileiro, que confere à casa de morada de família uma proteção absoluta, considerando-a um bem impenhorável. Concomitantemente, analisaremos a possibilidade de a penhora deste bem afrontar um direito constitucionalmente protegido, como o é, o direito à habitação. Recentemente, com a Lei nº 13/2016, de 23 de maio, foi reconhecida a extrema importância que a casa de morada de família assume para a estabilidade familiar. Com efeito, impediu-se que esta pudesse ser vendida no âmbito das execuções fiscais. Todavia, a interpretação que se tem feito da Lei nº 13/2016, de 23 de maio não tem sido unânime. Assim, em harmonia com a Jurisprudência recente, analisaremos as alterações introduzidas por esta Lei e o seu âmbito de aplicação. Por fim, aproveitaremos para proceder a uma breve análise da suspensão ad nutum da prescrição, que ocorre sempre que existe o impedimento legal à realização da venda, bem como, do desvirtuamento a que a figura da penhora se encontra sujeita.-------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------
