Courts in contemporary societies : a case study on Portugal

L'important rôle social et politique des tribunaux apparaît de plus en plus comme un des thèmes importants de la science politique contemporaine. Ainsi, une recherche réalisée sur la justice portugaise décrit la nature nouvelle des relations entre les citoyens et les tribunaux, en prenant en compte le niveau de connaissance que ces citoyens ont de leurs droits et leurs opinions sur la justice. Une observation est entreprise des conditions dans lesquelles le recours à la justice est effectué en relation avec le type de conflit. Les tribunaux de première instance constituent le terrain choisi pour cette analyse du traitement judiciaire, au civil et au pénal.One of the most intriguing phenomena of contemporary political science is the recent and increasingly leading social and political role of the courts. In this paper we will present some results of a research project on Portuguese courts. The central aim of this study is twofold. It is, on the one hand, to analyse in general the perceptions and appraisals of citizens concerning the judicial System, on the other, to analyse the work of the lower courts as institutions for the resolution of lawsuits, either criminal or civil cases
