Gestão de cartas precatórias: uma proposta de aperfeiçoamento para a prestação jurisdicional

It is a propositional dissertation that aimed to improve the system of management of precatory letters, in order to guarantee better efficiency to the jurisdictional provision by precatory letters. Initially, the nine articles that comprise the communication of a procedural act of the species "letter" in the Code of Civil Process, articles 260 to 268, are showed, with the scope of delimiting the theme. The species of letter: precatory, order, rogatory and arbitration are analyzed in detail according to the process doctrine constituting theoretical reference. The field dimension of the survey notes that from September 1999, the date of creation of the specialized Gurupi Precatory Law Court, up to December 2018, 30.151 precatory letters were received and the situation of the processes month to month during this period; to provide speed and efficiency in the fulfillment of the letters, given that the annual average amount of receiving 2200 letters is considered as a challenge, as well as the management in the Judiciary is fundamental for the improvement of the jurisdictional provision. With the quantitative and qualitative analysis of the precatory letters, it can be seen that failure to comply with the requirements of the Code of Civil Process combined with non-compliance with the rules of the Tocantins State Courts of Justice, constitute the factor of effective non-compliance with letters, and the absence of essential documents, which should necessarily accompany the letter and the insufficiency and/or lack of addresses declined in the letters are the problems with the highest incidence rate. To communicate by letter of precatory is necessary and precise, because not all process is satisfied in the own region, for that reason must be observed all the legal norms. The research concluded by requesting the Tocantins State Courts of Justice to forward recommendations to all the courts that are part of the Court of Justice of Tocantins (TJTO), as well as to the Corregedoria of the other States and Corregedoria of the National Council of Justice. (CNJ) to comply with the requirements of article 260 and sequences of the CPC when issuing pre-emptive letters and the drafting of a single standard model of letter of formal notice that establishes the identity of the TJTO and meets all the requirements of the CPC.Trata-se de dissertação propositiva que objetivou melhorar o sistema de gestão de cartas precatórias, a fim de garantir melhor eficiência à prestação jurisdicional via carta precatória. Inicialmente são apresentados os nove artigos que compõe a comunicação de ato processual da espécie “carta” no Código de Processo Civil, artigos 260 a 268, com o escopo de delimitar o tema. As espécies de carta: precatória, de ordem, rogatória e arbitral são detalhadamente analisadas de acordo a com a doutrina processual constituindo referencial teórico. A dimensão de campo da pesquisa anota que de setembro de 1999, data de criação da vara especializada de Precatórias de Gurupi, até dezembro de 2018 foram recebidas 30.151 cartas precatórias e diagnostica a situação dos processos mês a mês durante este período; proporcionar celeridade e eficiência no cumprimento das cartas, dado o quantitativo médio anualmente de recebimento de 2200 cartas é apontado como desafio, assim como a gestão no Poder Judiciário é fundamental para o aperfeiçoamento da prestação jurisdicional. Com a análise quantitativa e qualitativa das cartas precatórias, pode-se constatar que a não observância dos requisitos disciplinados pelo Código de Processo Civil aliado à inobservância às normas da Corregedoria-Geral de Justiça do Estado do Tocantins, constituem o fator de não cumprimento efetivo das cartas, sendo que a ausência de documentos essenciais, os quais deviam obrigatoriamente acompanhar a carta e a insuficiência e/ou inexistência dos endereços declinados nas cartas são os problemas com maior índice de incidência. Comunicar via carta precatória é necessário e preciso, pois nem todo processo se satisfaz na própria comarca, por isso devem ser respeitadas e observadas todas as normas legais. A pesquisa concluiu por solicitar à Corregedoria-Geral da Justiça do Estado do Tocantins o encaminhamento de recomendações a todas as varas e comarcas integrantes do Tribunal de Justiça do Tocantins (TJTO), bem como às Corregedorias dos outros estados federativos e Corregedoria do Conselho Nacional de Justiça (CNJ) para que observem os requisitos do artigo 260 e seguintes do CPC quando da expedição de cartas precatórias e a redação de um modelo padrão único de carta precatória que imprima a identidade do TJTO, contemplando todos os requisitos exigidos pelo CPC
