«قدرت تامه» شرط انشاء، فعلیت یا تنجز؟ دوره51 شماره1 سال1398

Ability is a general requirement of duty which is sometimes considered due to non-ability to fulfill the duties simultaneously and is known as perfect (legal) ability. The question is at what stage of percept (creation, actuality and non-contingency); non-ability to fulfill two duties simultaneously is effective? In this regard, three main doctrines have developed among Usulis: Akhund and Shahid Sadr maintain that legal ability is a requirement for the creation stage, Naeini believes that legal ability is a requirement for the actuality stage, Imam Khomeini, Sheikh Hassan Helli and Mohaghegh Tehrani are of the opinion that legal ability delimits the non-contingency stage and has no effect on the two previous stages. In this paper, after explaining different opinions concerning the above said three doctrines and the problems related to each opinion, the authors have concluded that: first, the rational ability must be altered at the creation stage and this stage must be restricted; since absolute speech as to incapables does not have the excitation and deterrence titles and leads to burdensome duty and absurdity; second, perfect and legal ability i.e. fulfilling two inconsistent duties, is of significance at the non-contingency stage; since in cases of inconsistency, usages of the wise is to consider themselves liable and attempt to find a way to obey.قدرت از شرایط عامه تکلیف محسوب می‌گردد که گاه به لحاظ عجز از جمع امتثال بین تکالیف در نظر گرفته می‌شود و از آن به عنوان قدرت تام (قدرت شرعی) نام برده می‌شود. پرسش این است که عجز از جمع بین دو تکلیف در مقام امتثال در چه مرحله‌ای از مراحل حکم (انشاء، فعلیت و تنجز) تأثیر دارد. در این خصوص سه مسلک عمده در بین اصولیان شکل گرفته است: مرحوم آخوند و شهید صدر قائل‌اند که قدرت شرعی، شرط برای مرحله انشاء است، مرحوم نائینی قدرت شرعی را مربوط به مرحله فعلیت می‌داند؛ امام خمینی، شیخ حسین حلی و محقق تهرانی برآنند که قدرت شرعی محدد مرحله تنجز است و در دو مرحله سابق اثری ندارد. در این جستار، ضمن بیان نظرات و تقریرات مختلف در مورد مسالک سه‌گانه و بیان اشکالات مربوط به هر یک از این نظرات، به این نتیجه رسیده‌ایم که اوّلاً در قدرت عقلی باید در مرحله جعل و انشاء تصرف نمود و این مرحله را محدود کرد زیرا خطاب مطلق نسبت به عاجزین، دارای عنوان داعویت و زاجریت نیست و به تکلیف ما لا یطاق و لغویت می‌انجامد؛ ثانیاً قدرت تامه و شرعی که همان جمع بین دو تکلیف متزاحم است در مرتبه تنجز دخیل است ؛چراکه در موارد تزاحم، سیره عقلا بر آن است که تکالیف را متوجه خود می‌بینند و در پی علاجی در مقام امتثال برمی‌آیند
