The free configuration of public procurements enables the parties to include provisions directed to ensure their completion and performance, such as the discounts for quality indicators and the penalty clauses. Although it is possible to consider these two clauses to have a retributive purpose, the research shows that only penalty clauses are punishing measures. While the discounts for quality indicators clauses are meant to maintain an equitable distribution amongst the rights and duties acquired by the parties, the imposition of fines punishes a delayed or incomplete contract performance.
