La auditoría ambiental en el derecho público

This has allowed articulating strategies of conservation and sustainable use of the natural resources of the environment and in general like principal paradigm. These advances have been inclusive to the normative development from the constitutional text to the civil matters, white-collar worker, taxpayer of the very juridical environment for his protection, well-founded from the constitutional doctrine, where the environmental rights become established for the citizen, the civic intervening participation the exercise of the popular power, that it allow attaining the beginning of the sustainable development. You execute an analysis referring to the environmental auditing between the instruments of market and commerce, linked to the public control. For such reasons, the objective of the article is to examine the elements that conform the juridical institution of the environmental auditing, it breaks of the reading of the doctrine and the standard, as from the juridical dogmatics with a logic analysis of how it happened, because it happened and in order that it happened that, of the juridical legal bodies they establish it, his abuttals with another knowledges and sciences.En el planeta se han alcanzado avances significativos en la política ambiental y dentro de esta la gestión ambiental en las organizaciones empresariales, ejecutada por los funcionarios públicos y personas naturales dentro del entramado de la Administración Pública y los órganos con competencia para ello. Este hecho ha permitido articular estrategias de conservación y aprovechamiento sustentable de los recursos naturales y del ambiente en general como principal paradigma. Estos avances han sido inclusivos al desarrollo normativo desde el texto constitucional hasta las materias civil, administrativa, tributaria del bien jurídico ambiente para su protección, fundamentado desde la doctrina constitucional, donde se establecen los derechos ambientales para el ciudadano, la participación ciudadana mediante el ejercicio del poder popular, que permita alcanzar el principio del desarrollo sostenible. Se ejecuta un análisis en lo referente a la auditoría ambiental entre los instrumentos de mercado y comercio, vinculados al control público. Por tales razones, el objetivo del artículo es analizar los elementos que conforman la institución jurídica de la auditoría ambiental, se parte de la lectura de la doctrina y la norma, a partir de la dogmática jurídica con un análisis lógico de cómo surgió, porque surgió y para que surgió, de los cuerpos jurídicos legales que la establecen, sus lindes con otros saberes y ciencias
