La constitucionalización de la economía social de mercado en Colombia

The Political Constitution of Colombia of 1991 did not mention which it would be the economic model of development that would regulate the State since that historic moment and on, however, due to the recognition of principles and rights with social content; and on the other hand, the protection of liberal rights, it is feasible to infer, that the adopted economic system in our bill of rights is the Social Market Economy, characterized by the free enterprise and private initiative, and a reduced state activity to warrant a minimum of social rights and services. With it, it is questioned whether the constitution is truly “open”. This article pretends to carry out a normative, doctrinal and jurisprudential analysis that supports that affirmation. In addition, it aims to review in a briefly form, the reforms that the State has had to face since the implementation of the referred economic system, reflecting if the advantages which has promised the Social Market Economy have been accomplished. The article also defends the idea of the necessity of an intervention from the Colombian State in the economy (without applying a planned economy), in order to reach the objectives that the constitution of 1991 devised for our country under the Social Rule of Law.La Constitución Política de Colombia de 1991 no señaló cuál sería el modelo de desarrollo económico que regiría al Estado desde ese momento histórico, sin embargo, del reconocimiento de principios y derechos de contenido social; y de otra parte, de la protección de derechos liberales; es factible colegir, que el sistema económico adoptado en nuestra carta de derechos es el de Economía Social de Mercado, caracterizado por la libertad de empresa e iniciativa privada, y una reducida intervención estatal para garantizar unos derechos y servicios sociales mínimos. Con ello, queda en duda el que la constitución sea verdaderamente “abierta”. Este artículo pretende realizar un análisis normativo, doctrinario y jurisprudencial que sustente esa afirmación. Igualmente apunta a revisar de manera sucinta, las reformas que ha tenido que afrontar el Estado a partir de la implementación del referido sistema de economía, reflexionándose acerca de si las ventajas que ha prometido la Economía Social de Mercado realmente se han cumplido. Se defiende en las conclusiones, la idea de la necesidad de la intervención del Estado colombiano en la economía (sin llegar al extremo de una economía planificada), para procurar alcanzar los fines que la constitución de 1991 trazó para nuestro país bajo el principio de Estado Social de Derecho
