Actividad contractual de entidades territoriales a la luz de los principios de la contratación estatal

This regulated nature has forced public servants and individuals who exercise public functions to subject all their administrative and contractual actions to what the Constitution and the law allow them. Hence, according to Article 6 of the Charter, public servants respond for breach of the Constitution and the Law and also for omission and overstepping their duties. However, some local authorities have chosen to depart from these provisions in the exercise of the contractual activity they carry out in the exercise of their powers and legal powers, which should be aimed at ensuring the provision of public services, Of the general interest and for the fulfillment of the purposes of the State, but in this context its purpose is misrepresented in the violation of the principles and normative values that underlie the actions of public servants. This article seeks to clarify this obligatory subjection of public authorities to the superior legal system in exercise of their contractual powers and in the development of this activity, referring to the regulations that govern today public procurement in Colombia and the challenges facing the Application of this, in the territorial entities in front of the citizen and judicial permissiveness that has been giving to the local representatives exorbitant faculties like the one to constitute smaller boxes, without legal permission for this and to destine its funds to the payment of contracts that do not comply with the Requirements for its validity.La actividad contractual en Colombia es de naturaleza reglada, por lo tanto la objetividad es su principal característica. Si bien en otras ramas del derecho la aplicación de la norma se ha hecho más transversal al incluir otras fuentes como la costumbre y el derecho de los jueces al nivel jerárquico de la ley, en derecho administrativo no se ha dado este fenómeno de manera tan absoluta, en virtud de los principios especiales que lo rigen y que lo convierten en una rama sujeta manifiestamente a la norma. Esta naturaleza reglada, ha obligado a los servidores públicos y a los particulares que ejerzan función pública a sujetar todas sus actuaciones, administrativas y contractuales, a aquello que la Constitución y la Ley les permitan. De allí que conforme al artículo 6 de la Carta, los servidores públicos respondan por infracción de la Constitución y la Ley y además por omisión y extralimitación en sus funciones. Sin embargo, algunas autoridades a nivel local han optado por apartarse de estas disposiciones en el ejercicio de la actividad contractual que desarrollan en uso de sus facultades y atribuciones legales, la cual, deberíaestar encaminada a asegurar la prestación de los servicios públicos, en función del interés general y para el cumplimiento de los fines del Estado, pero que en este contexto se tergiversa su finalidad en la transgresión de los principios y valores normativos quefundamentan el actuar de los servidores públicos.En el presente artículo se pretende aclarar esta sujeción obligatoria de las autoridades públicas al ordenamiento jurídico superior en ejercicio de sus facultades contractuales y en desarrollo de esta actividad, referenciando la normatividad que rige hoy por hoy lacontratación pública en Colombia y los desafíos que enfrenta la aplicación de esta, en las entidades territoriales frente a la permisividad ciudadana y judicial que ha venido otorgandoa los mandatarios locales facultades exorbitantes como la de constituir cajas menores, sin permiso legal para ello y destinar sus fondos al pago de contratos que no cumplen con los requisitos normativos para su validez.
