The following article deals with an analysis of the relationship between modernity and discourse about rights, equality and their guarantees. The relationship between modernity and fundamental rights was defined as being necessary for explaining the concepts and conditions of equality in the contemporary social and democratic state under the rule of law from a comprehensive viewpoint. This supposed that a concept of social theory and philosophy concerning rights and equality could not be constructed independently of understanding the modernity in which institutions and social theories evolve.
