Reglas de prueba en el incidente de reparación integral

This paper aims to elucidate what evidentiary rules that must be applied in the event of full compensation, since in the Colombian legal practice is difficult to establish if they are to be the Code of Procedure of the General presented are or the Code of Criminal Procedure, there being no agreement yet on that aspect. Therefore, and for such purposes will first proceed to define the legal problem, showing various responses given by the national law, then provide a plausible solution to that question from the point of view of jurisprudence and constitutional.El presente artículo tiene por objeto dilucidar cuáles son las reglas probatorias que deben de ser aplicadas en el incidente de reparación integral, puesto que en la praxis judicial colombiana se presenta la dificultad de establecer si han de ser éstas las del Código General del Proceso o las del Código de Procedimiento Penal, no existiendo acuerdo aún en dicho aspecto. Por lo tanto y para tales efectos se procederá primero a delimitar el problema jurídico, mostrando las diversas respuestas dadas por la doctrina nacional, para luego brindar una solución plausible al citado cuestionamiento desde el punto de vista jurisprudencia! y también constitucional
