Competencia desleal por culpa

The article examines the unlawfulness in acts of unfair competition, provided as a hypothesis of non-contractual civil liability in Law No. 20.169, which regulates unfair competition. Refuting an interpretation made by national scholars and courts, which states that such illicit requires proof of a fraudulent behavior, the article argues how the text of this law, the reliable history of its establishment, its systematic interpretation with others normative bodies (in particular, with the consumer protection that underlies as a legitimate interest expressly in this special law), the consideration of certain comparative experience and, even, a recent jurisprudence of the Supreme Court, allow to sustain in a well-founded manner that a conduct of unfair competition that infringes the ordinary diligence (slight fault) configures that illicit and gives rise to the exercise of the actions that this law establishes.El artículo examina la ilicitud en los actos de competencia desleal, previstos como una hipótesis de responsabilidad civil extracontractual en la ley N° 20.169, que regula la competencia desleal. Refutando una interpretación efectuada por parte de la doctrina nacional y de la jurisprudencia, que afirma que tal ilícito exige la prueba de una conducta dolosa, se argumenta cómo el texto de esta ley, la historia fidedigna de su establecimiento, su interpretación sistemática con otros cuerpos normativos (en particular, con la protección al consumidor que subyace como interés legítimo expresamente en esta ley especial), la consideración de cierta experiencia comparada e, Incluso, una reciente jurisprudencia de la Corte Suprema, permiten sostener de manera fundada que una conducta de competencia desleal que infringe la diligencia ordinaria (culpa leve) configura ese ilícito y da lugar al ejercicio de las acciones que esta ley establece
