Mecanismos de defensa del consumidor en el ordenamiento jurídico argentino

This paper reviews the different actions available for a consumer affected by the supplier through different ways of incompliance, and by which, after some legal requirements are met, the consumer would obtain a reparation or the substitution of the defective good or service and, on the other side, the price reduction action, and at last, the contract resolution according to the Argentinean consumer protection regime. The first case rises from the binding force of the supplier’s offering and is based on the satisfaction of the consumer’s expectations when buying. The second one relates to the legal guarantee and legal obligation for guaranteeing an adequate technical service and supplying parts and replacement pieces. Finally, we address the especial consideration given to redhibitory flaws within consumption rights, both in the specific regulation and in the new Civil and Trade National Code.Reseñamos en este trabajo las distintas acciones que posee el consumidor perjudicado por el incumplimiento del proveedor en diversos supuestos, por las cuales, y cumplidos sus presupuestos legales, el consumidor puede obtener la reparación o la sustitución del bien defectuoso o del servicio que haya sido prestado deficientemente y, por otro lado, la acción estimatoria o reducción delprecio, y en última instancia, la resolución del contrato, conforme al régimen tuitivo consumidor en el derecho argentino. El primer supuesto nace del carácter vinculante de la oferta hecha por el proveedor, y tiene su base en la satisfacción de las expectativas puestas por el consumidor al contratar. El segundo versa sobre la garantía legal y la imposición normativa de la garantía de servicio técnico adecuado y provisión de partes y repuestos. Por último, nos referiremos a la especial consideración que respecto a los vicios redhibitorios tiene el derecho del consumo, tanto en la ley especial como en el nuevo Código Civil y Comercial de la Nación
