Los instrumentos para la tutela de los derechos fundamentales en España y en Italia. La previsión y la ausencia del amparo constitucional

The article analyses the two different fundamental rights protection systems that are provided by Spanish and Italian Constitutions. On one hand, the prevision of a direct recurso de amparo, an instrument of protection whose importance is not only legal but also social; on the other, the highly disputed choice of a system which does not provide for any possibility of direct recourse to the Constitutional Court. The comparison does not show that one system is more guaranteeing than the other, but it provides interesting and useful observations in a perspective of reform and improvement of the system. Taking into consideration that the effectiveness of a reform is strongly linked to the interpretation and application given by the Constitutional Court.El artículo es el resultado del análisis de los dos diferentes sistemas de tutela de los derechos fundamentales que proporcionan, respectivamente, el derecho español e italiano. Por un lado, un ordenamiento que prevé el recurso directo de amparo, instrumento de protección cuya importancia no es solo jurídica sino también social; por el otro la elección, ponderada y muy discutida, de un sistema que no prevé ninguna posibilidad de un recurso directo al Tribunal Constitucional. La comparación no demuestra que un sistema es más garantista que el otro, pero puede proporcionar observaciones interesantes y útiles en una perspectiva de reforma y de mejora (teniendo en cuenta que la eficacia de las mismas está fuertemente vinculada a la interpretación y aplicación por parte del Tribunal Constitucional)
