Derecho a la protección de la salud en el sistema constitucional mexicano y español

The World Health Organization states that the enjoyment of the highest standard of health that can be achieved is one of fhe Fundamental rights of every human being. In Mexico, the right to health protection is a fundamental right that forms part of the First Title I of Human Rights and its Guarantees of the Political Constitution of the United Mexican States. However, in Spain, this right is not found in the catalog of fundamental rights established in Title I, Chapter Two, Rights and Freedoms, Section 1ª Of the Fundamental Rights and the public liberties and of the rights and duties of the citizens, articles 14 to 29 and 30.2, of the Spanish Constitution, therefore it is considered like a guiding principle of the social and economic policy. The objective of the present study is to confront the similarities and the differences between fundamental rights in legal systems Mexican and Spanish on the right to the protection of the health highlighting a comparison between the juridical nature, organization and characteristics of the protection to the health.La Organización Mundial de la Salud afirma que el goce del grado máximo de salud que se pueda lograr es uno de los derechos fundamentales de todo ser humano. En México, el derecho a la protección de la salud es un derecho fundamental que forma parte del Título Primero Capítulo I De los Derechos Humanos y sus Garantías de la Constitución Política de los Estados Unidos Mexicanos. En España, este derecho no se encuentra en el catálogo de derechos fundamentales establecidos en el Título I, Capítulo segundo, Derechos y libertades, Sección 1ª De los derechos fundamentales y de las libertades públicas y De los derechos y deberes de los ciudadanos, artículos 14 a 29 y 30.2, de la Constitución Española; pues es considerado como un principio rector de la política social y económica. El objetivo del presente trabajo es confrontar las semejanzas y las diferencias entre los derechos fundamentales en los sistemas jurídicos mexicano y español sobre el derecho a la protección de la salud resaltando una comparación entre la naturaleza jurídica, organización y características de la protección a la salud
