This paper offers a reflection on the "human way of having" both from a private perspective –related to the notion of dominium– and a public one –ius or right–. After presenting an anthropological foundation of domain, it analyzes domain’s historical evolution and especially the strange case of "domain without property" that Franciscan voluntary poverty proposes, which opened the possibility of a spiritualist conception of domain. This perspective later contributed to the fact that, in modernity, a split between the notions of law and right emerged.
