El concepto de bürgerliche Gesellschaft en la Filosofía del Derecho de Hegel y su crítica marxiana

The concept of civil society arises a series of relevant considerations. The german expression bürgerliche Gesellschaft used by Hegel contains a characteristic semantic ambiguity and it is peremptory to reconstruct its conceptual history. The expression has been generally translated to spanish as “sociedad civil” (civil society) and to a lesser extent as “sociedad burguesa” (bourgeois society). The history of the term recovered by Hegel contemplates both senses. The core of this work will be dedicate to a detailed analysis of the internal logic of the bürgerliche Gesellschaft. In order to locate sufficiently this section in the Philosophy of Right we will schematically explain, in the first place, the general structure of this work. In the second place we will present the dialectical configuration of the System of Ethical Life. The dialectics of the bürgerliche Gesellschaft are constituted by three moments: a) the system of Needs, b) the administration of justice and c) the police and the corporation. We will articulate the analysis of these three moments with the appropiate passages of the marxian critic of Hegel’s Philosophy of Right. This marxian critic will show the limits and problems of the bourgeois liberal paradigm and the need for its overcoming.El concepto de sociedad civil suscita una serie de consideraciones relevantes. El término alemán bürgerliche Gesellschaft utilizado por Hegel contiene una ambigüedad semántica característica y es perentorio reconstruir su historia conceptual. La expresión ha sido traducida al español generalmente como ‘sociedad civil’ y, en menor medida, como ‘sociedad burguesa’. La historia del término recuperada por Hegel contempla ambas acepciones. El núcleo del trabajo estará dedicado a un análisis pormenorizado de la dialéctica interna de la bürgerliche Gesellschaft. Con la finalidad de situar suficientemente esta sección en la Filosofía de Derecho, expondremos esquemáticamente, en primer lugar, la estructura general de dicha obra. En segundo lugar presentaremos el ordenamiento dialéctico del Sistema de la Eticidad (Sittlichkeit). La dialéctica de la bürgerliche Gesellschaft está constituida por tres momentos: a) el sistema de las necesidades, b) la administración de la justicia y c) la policía y la corporación. Articularemos el análisis de estos tres momentos con los pasajes pertinentes de la crítica marxiana a la Filosofía del Derecho de Hegel. Esta crítica marxiana pondrá en evidencia los límites y problemas del paradigma burgués liberal y la necesidad de su superación
