Entre quejas confiadas y súplicas de amparo: una aproximación a la condición de la mujer en el Río de la Plata a fines del siglo XVIII

The present work focuses on the analysis of specific instances approached for a direct claim to the Monarch valid at the end of the Ancient Regime, which were open even for women. We refer in this case to the representations which, in form of supplication or motivated proposition addressed to the Princes and Superiors, were open to all their vassals and set in the center of the scene having the King’s most important function as the dispenser of justice. We worked with General Archive of the Indies ́s sources, identifying three cases belonging to the middle and high sectors of the ambit of the Río de la Plata, whose appeals to the king at the end of the XVIII century had different scopes, limits and courses. In this way the existence of individual actions of relationship with power is revealed in a period in which women were equated to a minor. From this perspective, the possibility to resort to the monarch in its double function as king and protector of his subjects and as a provider of justice appears as a recursive way, which in terms of “entrusted complaints” and “supplications for protection” concerning women’s studies seems to be still unexplored. We pretend to contribute with this study to the denaturing of the conceptions that came later and were related to the situation of women in this period; the one that was previous to the fragmentation of the colonial order and the advent of a new period which paradoxically will be reluctant to freedoms.El presente artículo se centra en el análisis de instancias específicas de reclamo directo al Monarca vigentes a fines del Antiguo Régimen y que se encontraban abiertas aún para las mujeres. Nos referimos en este caso a las representaciones que, en forma de súplica o proposición motivada que se hacía a los Príncipes y Superiores, estaban abiertas a todos sus vasallos y ponían en el centro de la escena la función más importante del Rey, en tanto dispensador de justicia. Trabajamos con fuentes del Archivo General de Indias, individualizando tres casos pertenecientes a los sectores medio y alto del ámbito rioplatense, cuyas apelaciones al Rey a fines del siglo XVIII tuvieron distintos alcances, límites y derroteros. Se devela así la existencia de acciones individuales de relaciones con el poder en una etapa donde las mujeres jurídicamente se hallaban equiparadas a un menor de edad. Desde esa perspectiva, la posibilidad de recurrir al monarca en su doble instancia de Rey y juez protector de sus súbditos y proveedor de justicia se recorta como una vía recursiva que, en términos de “quejas confiadas” y “súplicas de amparo”, en lo que atañe a los estudios sobre las mujeres todavía parece inexplorada. Pretendemos con este estudio contribuir a la desnaturalización de concepciones posteriores, relativas a la situación de las mujeres en la etapa previa al resquebrajamiento del orden colonial y del advenimiento de una nueva etapa que, paradójicamente, será renuente en libertade
