El principio de interés superior del niño como presupuesto de garantía de efectividad en el sistema interamericano de derechos humanos

The best interests of the child is the transverse axis of Corpus Juris international human rights of children and adolescents, is an integral part of the Convention on the Rights of the Child 1989, which stands out as the international treaty most ratified in the world, since, with the exception of the United States, all states have recognized and introduced in their legislation, accepting the binding force of its principles regarding human rights of children and adolescents.The Inter-American System of Human Rights has ruled multiple opportunities in the sense that children are not only subject to special protection but are of special individual protection personal.In the present work is to determine a notion of interests of the child from the analysis of the performances of the Inter-American Human Rights System, by which it has exercised sovereign defense of the rights of children and adolescents in the Americas, including Colombia.El principio de interés superior del niño es eje transversal delCorpus Juris Internacional de los Derechos Humanos de los niños,niñas y adolescentes, hace parte integral de la Convención sobrelos Derechos del Niño de 1989, la cual se destaca por ser el tratadointernacional más ratificado en el mundo, dado que, con laexcepción de Estados Unidos, todos los estados le han reconocidoe introducido en sus ordenamientos jurídicos, aceptando lafuerza vinculante de sus postulados en relación con los derechoshumanos de los niños, niñas y adolescentes.El Sistema Interamericano de Derechos Humanos en múltiplesoportunidades se ha pronunciado en el sentido de que los niñosno son sólo sujetos de protección especial, sino que son plenossujetos de derecho.Mediante el presente trabajo se pretende delimitar una nociónde interés superior del niño desde el análisis de las actuacionesdel Sistema Interamericano de Derechos Humanos, mediante lascuales ha ejercido la defensa soberana de los derechos de niños,niñas y adolescentes en las Américas, incluyendo a Colombia.Palabras clave: Derechos del niño, interés superior delniño, derechos humanos, Sistema Interamericano de DerechosHumanos, Comisión Interamericana de Derechos Humanos,Corte Interamericana de Derechos Humanos
