La selección del método en la investigación jurídica. 100 métodos posibles

The aim of this paper is to open up new perspectives about the wide range of research methods that can be use for academic purposes, avoiding reductionism when selecting a method. The work is based on a theoretical perspective that first describes the essence of the method and its role in science; then checks systematically the multiplicity of methods by grouping them under five broad criteria; and finally deduces four general proposals on methodology. The first chapter introduces the meaning of the method, its role in science and the need for its use. The second chapter begins by outlining five synthetic classifying criteria, parallel to the five elements of science, that later will be used to group the different methods. Over a hundred different methods are classified. In chapter three the criticism of the use of methods is made. Considering the issues discussed in the three preceding chapters, chapter four presents four methodological recommendations: do not stick to one research method, combine several methods, choose the most appropriate to the subject of study, and always take at least a research method that correlates theory with reality. The main conclusion is clear: using just one method for academic purposes denotes great intellectual poverty.El objeto de las presentes líneas es abrir perspectivas sobre la gran variedad de métodos de investigación que pueden usarse en la academia, evitando los reduccionismos en la selección del método. Se trabaja desde una perspectiva teórica que primero describe la esencia del método y su rol dentro de la ciencia, luego revisa sistemáticamente la multiplicidad de métodos agrupándolos bajo cinco criterios generales, para finalmente deducir cuatro propuestas generales sobre la metodología. El primer capítulo, introduce al significado del método, a su rol dentro de la ciencia y a la necesidad de su uso. El segundo capítulo inicia delineando cinco sintéticos criterios clasificatorios, paralelos a los cinco elementos de la ciencia, que luego servirán para agrupar los distintos métodos. Se clasifican más de cien métodos distintos. En el capítulo tres se hace la crítica al uso de los métodos. Tomando en cuenta todo lo expuesto en los tres capítulos precedentes, en el capítulo cuatro se deducen cuatro recomendaciones metodológicas: no casarse con ningún método de investigación, combinar varios de ellos, escoger los más adecuados a la temática de estudio, y adoptar siempre al menos un método de investigación que correlacione la teoría con la realidad. La conclusión principal es clara: usar un solo método en la academia denota una gran pobreza intelectual
