El pluralismo jurídico. Un desafío al Estado contemporáneo

The article criticizes the legal theory that defends “juridical monism”, i.e., the uniqueness, hegemony and exclusive operation of the juridical system in the modem State. Instead, the author points out the existence of what is known as "juridical pluralism”: the coexistence of numerous normative Systems within the same social sphere. Beginning with this premise, the author builds his discourse, aimed to show the fallacy and fiction of the juridical legitimacy of the State and to warn us of the State’s gradual loss of its juridical monopoly in favor of a more real juridical pluralism.El artículo critica la teoría del derecho que defiende el “monismo jurídico”, esto es, la unicidad, hegemonía y operatividad exclusiva del sistema jurídico en el Estado moderno. En vez de esto, el autor hace hincapié en la existencia de lo que se denomina “pluralismo jurídico”: la coexistencia en un mismo espacio social de numerosos sistemas normativos. A partir de esta base, el autor construye su discurso, mismo que está dirigido a mostrar la falacia y ficción de la legitimidad jurídica del Estado y a prevenir de su paulatina pérdida del monopolio de la juridicidad en aras del más realista pluralismo jurídico
