Linguagem, linguagens e Direito

This paper discusses the question of legal language, emphasizing the importance and sometimes need to use Latin in legal documents. In order to work with this topic, we tried to understand the reasons for the use of Latin expressions rather than the national language in legal texts and the impossibility, in most cases, of translating those expressions. Based on this initial premise of the criticism of the use of Latin in the legal field, we seek to briefly examine the rituals, traditions and technicalities in law and how they are influenced by the changes brought by globalization.Key words: law, Latin, language.O presente trabalho aborda a questão da linguagem jurídica, com ênfase na importância e por vezes necessidade do uso do latim em documentos jurídicos. Para trabalhar com tal temática, procurou-se entender os motivos que levam à utilização de expressões latinas em vez de vernáculos da língua nacional nos escritos do Direito, bem como a impossibilidade de, na maioria dos casos, traduzir a expressão utilizada. Partindo-se dessa premissa inicial das críticas ao uso do latim na área jurídica, busca-se, ao longo do estudo, analisar brevemente os ritualismos, tradições e tecnicismos na área do Direito e como estes são influenciados pelas mudanças trazidas pela globalização.Palavras-chave: Direito, latim, linguagem.
