A justiça e a democracia como hipérbole: o PNDH-3 e o projeto constituinte do Estado Democrático de Direito entre nós

As a modern constitution, the Brazilian Constitution of 1988 is the starting point of a constitutional project. This article discusses the relationship between that project and the National Program of Human Rights (PNDH-3). At first, it focuses on the openness to the future as the basis of the legitimacy of modern constitutions. Then it presents the problems of the constitution’s interpretation and identity. Next, it discusses the PNDH-3 as an important moment of the continuous process of interpretation of the Brazilian Constitution. Finally, it addresses the relationship between the constitutional project of the Democratic Rule of Law and justice and democracy understood as hyperbole.Key words: constitution, constitucional identity, human rights.Como uma constituição moderna, a Constituição de 1988 é o marco inicial de um projeto constituinte. Este artigo aborda a relação entre esse projeto e o Programa Nacional de Direitos Humanos (PNDH-3). Em primeiro lugar, foca-se na abertura ao futuro como a base de legitimidade das constituições modernas. Em seguida, apresentam-se os problemas da interpretação constitucional e da identidade constitucional. Após, discute-se o PNDH-3 como um momento importante do processo contínuo de interpretação da Constituição Brasileira. Finalmente, dirigem-se as atenções para a relação entre o projeto constituinte do Estado Democrático de Direito e a justiça e a democracia compreendidas como hipérbole.Palavras-chave: constituição, identidade constitucional, direitos humanos.
