El patrimonio arqueológico y su protección jurídica en Cuba

The judicial framework of archeological heritage in Cuba began to take shape in the first two decades of the twentieth century. However, this only became apparent in Cuban law in the 1940s, and then after that in the 1970s with the approval of Laws 1 and 2 of the National and Local Monuments. This article thus investigates the judicial framework of the archeological aboriginal heritage in Cuba from its genesis to the present and, furthermore, analyzes the definition and the interrelationships between two fields of action: the archaeology and the heritage.El marco jurídico de protección del patrimonio arqueológico en Cuba comienza a gestarse en las dos primeras décadas del siglo XX. En cambio, en la legislación cubana será visible en los años cuarenta y, con posterioridad, en los setenta con la aprobación de las Leyes 1 y 2 de los Monumentos Nacionales y Locales. Al efecto, en el presente artículo se indaga sobre el marco jurídico para la protección del patrimonio arqueológico aborigen en Cuba, en su génesis hasta la actualidad, además de examinarse la definición de patrimonio arqueológico y la interrelación entre estos dos campos de acción: la arqueología y el patrimonio
