Based on international agreements and the Peruvian Constitution this paper argues that the legal framework in Peru recognizes a right to water supply. The causes why this right is actually not in force are analyzed, particularly with regard to the managerial and economic constraints faced by the state own companies. Also, the concepts of public good and public domain good are discussed as a framework to analyze the alleged conflict between the recognition of a human right to water and the economic value of this resource. The author makes a case for private involvement to provide management capabilities and capital based on the lack of both in the public sector.
