La teoría del derecho en la obra de Piero Calamandrei

The Works of Calamandrei are not only a brilliant thinking labour but also an elegant clear and witty literature work with a profound humanity. After a biographic approximation to Calamandrei's life, this study focuses on his Theory about rights from the perspective of the imbrications between political and civil rights and social rights, and on his thinking about the problematic "constitutionalization" of the social rights. On the other hand, this article describes the evolution of the author's thinking which progresses from a dogmatic and syllogistic position of the process to a modern and realistic position about the creative role of the judge and the need of collaboration between the ordinary and constitutional jurisdiction in defence of the transforming jurisdictional activity.La obra de Calamandrei además de una destacada y brillante labor de pensamiento, es un elegante, nítido y agudo trabajo de literatura, y de profunda humanidad. Tras una aproximación biográfica de Calamandrei, el trabajo se centra en su Teoría sobre los derechos desde la perspectiva de la imbricación entre los derechos civiles y políticos y los derechos sociales, así como en su pensamiento sobre la problemática "constitucionalización" de los derechos sociales. Por otro lado, de la concepción de Calamandrei sobre la aplicación del Derecho y la función jurisdiccional, el presente estudio destaca la evolución del pensamiento del autor que pasa de una posición dogmática y silogística del proceso a una concepción finalística de verdad y justicia, así como su postura moderadamente "realista" sobre la vertiente creativa del juzgador y sobre la necesaria colaboración entre la jurisdicción ordinaria y la constitucional en su defensa sobre la función "transformadora" de la actividad jurisdiccional
