Orígenes de la justicia constitucional: Atenas

Constitutional Justice in its variants of Judicial Review, Constitutional Tribunal or their hybrids, is indubitably a key feature in Western legal systems. A quest for its origins, however, is always an opportunity to review it in a new perspective and explore insights that could lead to further development. For that purpose, the present article focuses on relocating the origin of Constitutional Justice, even before the iconic Bonham Case (England) and Marbury v. Madison (usa). Following Mauro Cappelletti’s work on the matter, this research goes back to ancient Greece, specifically analyzing the procedure known as graphē paranómōn. The findings will show that the principles of Constitutional Justice were present in such procedure, which is relevant as it proves that Democracy and Constitutional Justice share a common origin in Athens, and that the latter is inherent to the first. La búsqueda de sus raíces constituye una oportunidad para observarla desde una nueva perspectiva y explorar argumentos que conduzcan a su constante desarrollo; por este motivo, el presente artículo se enfoca en ubicar el origen de la justicia constitucional, incluso antes de los icónicos casos Bonham (Inglaterra) y Marbury vs. Madison (Estados Unidos de América). Con base en el trabajo de Mauro Cappelletti en la materia, esta investigación se remonta a la antigua Grecia y en ella se analiza, específicamente, el proceso conocido como graphē paranómōn.
