Algunas consideraciones de la denominada nulidad por principios

In exercise of the jurisdictional-constitutional function, specifically referred to electoral contents, the upper instance of the Mexican Electoral Court of the Federal Judiciary established, as a cause of invalidity of a popular election, not covered nor regulated by the applicable electoral general act, the abstract nullification or nullity by principles. According to it, the constitutional regulation about popular elections, allows to infer some basic, imperative and inalienable principles that must be followed, in order to consider an election to be an authentic and truly democratic one; if those principles are breach, the election is considered to be invalid and vitiated, susceptible of being nullified. That judicial criteria, of great interest but controversial as well, illustrates the complexity of the arguments and the interpretation performed by the constitutional electoral justice system, which is intended to consolidate the democratic rule of law. Some of the critics that had been argued against the lawfulness of this special kind of nullification are the following: the observance of due process concerning electoral nullifications; the possible breach of the definitiveness principle (need to exhaust all the stages of the electoral procedures); the task of providing those principles of real content and efficiency, in a both, coherent and consistent way; the involuntary ─but possible─ emergence of mistrust and legal uncertainty regard the elections; the undesirable ─but possible too─ invitation to vitiate or jeopardize the electoral process, because once the election day is through and done, there could be irregularities subject to judicial scrutiny with annulling effects; and the accretion of more difficulties to other intrinsically complex topics, as the due way of proving the facts, and the determinant character of the transgressions. In sum, it’s another example of the valuable contributions that the Mexican Electoral Court of the Federal Judiciary has given to constitutional justice and the science of lawEn el ejercicio de su función jurisdiccional constitucional en materia electoral, la Sala Superior del Tribunal Electoral del Poder Judicial de la Federación (TEPJF) estableció como causa de invalidez de una elección, no prevista expresamente en la ley, la nulidad abstracta o nulidad por principios. Según ésta, de la norma constitucional se desprenden principios imperativos e irrenunciables que una elección debe observar para ser considerada libre, auténtica y democrática; ante su violación, se actualiza una elección viciada e inválida, susceptible de anulación. Dicho criterio, polémico y de gran interés, ejemplifica la complejidad del trabajo argumentativo y de interpretación de la justicia constitucional electoral, que tiende a consolidar el Estado constitucional y democrático de derecho. Entre los puntos críticos que dicha nulidad ha enfrentado se pueden mencionar: la presunta inobservancia del principio de legalidad en materia de nulidades electorales; la posible afectación al principio de definitividad de las etapas del proceso electoral; la provisión de contenido y eficacia, en forma congruente y consistente, a los principios; la involuntaria ─pero posible─ invitación a viciar los procesos electorales, pues una vez concluida la elección habría irregularidades sujetas a escrutinio judicial con eficacia anulatoria, y la adición de mayor dificultad a otros asuntos no sencillos, como la prueba de hechos y el carácter determinante de transgresiones.
