El acceso a la justicia y el derecho a la diversidad sexual, de género y sexualidad

This article addresses, as a general topic, the access to justice and the recognition of the right to sexual diversity, with a particular emphasis on the strategic use of law. The first part revisits the discussion about the definition of access to justice that was analyzed in previous texts (Begala and Lista, 2002; Lista, 2010; Lista, 2011). A distinction is made between the formal and substantive approach, to adopt the latter as the theoretical framework of the work. The following analysis is focused on the struggle of the LGBTTTI community for their rights, which led to the Marriage Act Nº 26,618, and on some of the existing and potential consequences of its entry into force. From this, the distinction between objective, subjective and symbolic obstacles of the access to justice, in general, is briefly mentioned to address, in particular, the challenge posed by the trans issue. Using data from interviews to male and female lawyers who are sexual diversity activists, some of those obstacles are analyzed, with a particular emphasis on those related to the professional-petitioner relationship; the empowerment of the latter for their involvement in the defense of their rights; the language as a barrier and as a strategic resource; and the attitude of employees, officials and judicial officers. In the conclusion, some implications of the legal recognition of minority rights are highlighted, and attention is drawn to the possible unwanted consequences of such recognition in connection with the continuity of the progress madeEl artículo aborda, como tema general, el acceso a la justicia y el reconocimiento del derecho a la diversidad sexual, con particular atención al uso estratégico del derecho. En la primera parte se retoma la discusión en torno a la definición de acceso a la justicia analizada en textos anteriores (Begala y Lista, 2002; Lista, 2010; Lista 2011). Se distingue entre la perspectiva formalista y la sustantiva, para adoptar a ésta última como marco teórico del trabajo. A continuación, el análisis se centra en la lucha por los derechos del colectivo GLBTTTI que condujo a la sanción de la Ley de Matrimonio Nº 26.618 y en algunas de las consecuencias actuales y potenciales de su entrada en vigencia. A partir de ello se alude brevemente a la distinción entre obstáculos objetivos, subjetivos y simbólicos al acceso a la justicia en general, para tratar, en particular, el desafío que plantea lo trans. Utilizando datos de entrevistas a abogados y abogadas activistas en favor del derecho a la diversidad sexual, se analizan algunos de tales obstáculos, con particular énfasis en los referidos a la relación profesional-peticionante; el empowerment de éste para la participación en la defensa de sus derechos; el lenguaje como barrera y como recurso estratégico; y las actitudes de empleados, funcionarios y magistrados judiciales. En las conclusiones se destacan algunas implicaciones del reconocimiento jurídico de los derechos de las minorías y se advierte sobre las posibles consecuencias no deseadas de dicho reconocimiento con relación a la continuidad de los logros obtenido
