A cultura jurídico-penal germânica altomedieval.

This study examines some important characteristics of the Germanic criminal legal culture of three Germanic peoples who lived in the old territories of the Western Roman Empire during the so-called High Middle Ages: the Visigoths (Iberian Peninsula) Lombards (Italian Peninsula) and Franks (Gaul). In the introduction, the three different (co-existing) cultures are indicated, which sought to exercise power during the beginning of the Middle Ages: the Germanic tradition, the Roman tradition and mystical Christian thought. Next, a brief historical context is provided to aid the reader to find his bearings among the particularities of the three Germanic kingdoms existing between the 6th and 8th centuries in the regions studied. Finally, some traits of Germanic legal criminal culture are highlighted, and their transformations caused by the remaining Roman legal tradition, through the influence of the Catholic Church as a source of legitimacy of the new European powers. In conclusion, a hypothesis is presented for general understanding of the criminal legal culture that prevailed in Medieval Europe, principally from the 9th century on, with the generalization of feudalism.Neste ensaio, são abordadas algumas características marcantes da cultura jurídico-penal germânica de três povos germânicos que se instalaram nos antigos territórios do Império Romano do Ocidente na chamada Alta Idade Média: os visigodos (Península Ibérica); longobardos (Península Itálica) e francos (Gália). Na introdução, são indicadas as três diferentes culturas (coexistentes) que tinham a pretensão de exercer o poder no início da Idade Média: tradição germânica; tradição romana e o pensamento místico cristão. Em seguida apresenta-se um sumaríssimo contexto histórico para situar o leitor nas particularidades dos três reinos germânicos existentes entre os séculos VI e VIII nas regiões abordadas. Finalmente, destacamse alguns traços da cultura jurídico-penal germânica e suas transformações diante da tradição jurídico-romana remanescente, além das influências da Igreja Católica como fonte de legitimação das novas potestades européias. Na conclusão, indica-se uma hipótese para a compreensão geral da cultura jurídico-penal que prevaleceu na Europa Medieval, mormente a partir do século IX, com a generalização do feudalismo
