La sociedad civil y el ciudadano en Venezuela frente al sistema de justicia a partir de la nueva constitución

Throughout 1999 in Venezuela a process was hatched which has lead to a chain of events of paramount importance both in the institutional and the political domain. A new Constitution was designed and approved that brought about substantial changes in the judiciary organization, in the role of civil society and of citizens in front of justice. In 1999 the Venezuelan constituent�s dream and intent was to create a �participating democracy� where justice should have been one of the main values (1999 Venezuelan Constitution, Article 2) and the Judiciary, a strong and independent body. With this object the new Constitution granted additional �citizen�s prerogatives� to Venezuelan People in face of the Justice administration, giving the People an increasing active role and setting forth obligations for the Judiciary towards the citizens. Through this work we shall endeavor to find out whether or not the Constituent�s intended purpose was made to come true in the years following the approval of the new Constitution. With this purpose an analysis shall be made of Venezuelan civil society and citizens, on the one side; and of the judiciary, on the other; facing one another, as active and passive subjects of the judiciary system, i.e., referring, on one hand, to the citizens� actual participation during those years and, on the other, to their actual access to justice. This analysis is necessarily limited to the study of the situation existing up to 2003. As a matter of fact, since 2004 a new Supreme Court of Justice Organic Law was approved and enforced, and, moreover, a great number of different measures were taken in the social, economic and political domain; measures whose impact has yet to be studied. Therefore the sources of this work are, of course, only the official studies and figures published by the end of 2003.En Venezuela, a lo largo de 1999, se produjo un proceso de profundas transformaciones en el ámbito institucional y político, que dio lugar a la aprobación de una nueva Constitución, la cual introdujo cambios sustanciales en la organización del sistema de justicia y en el rol de la sociedad civil y del ciudadano frente a la justicia. La aspiración del Constituyente venezolano de 1999 era la de constituir una democracia participativa y un Estado democrático donde la Justicia fuera uno de sus valores fundamentales (Artículo 2 de la Constitución) y el Poder Judicial, un órgano independiente y fuerte, y con ese fin la nueva Constitución �ciudadanizó� a los venezolanos frente a la administración de Justicia, otorgándoles un papel más activo y estableciendo obligaciones para el Poder Judicial frente al ciudadano. En este trabajo se pretende determinar si el propósito del Constituyente se materializó durante los años siguientes a la promulgación de la nueva Constitución. Para ello se hace un análisis de la situación de la sociedad civil y del ciudadano frente a la Justicia en Venezuela, como sujetos activos y pasivos del Sistema de Justicia, es decir, se hace referencia, por una parte, a la participación ciudadana en esos años y por la otra, al acceso a la justicia. El análisis de la sociedad civil venezolana y del Sistema de Justicia se refiere fundamentalmente a la situación existente para el año 2003, ya que a partir del año 2004 entró en vigencia una nueva Ley Orgánica del Tribunal Supremo de Justicia y se han tomado una serie de medidas en el ámbito social, económico y político, cuyo impacto no ha sido aún objeto de estudio.
