La jurisprudencia sobre las excepciones relativas a la seguridad en el acuerdo gatt

This article reviews the case law on the exceptions laid down in Article XXI of the GATT 1947 and GATT 1994, which enabled the GATT Contracting Parties, and still to the WTO members, to depart from their obligations under the GATT in order to protect their essential security interests. Emphasis will be made in the most controversial exception amongst the ones related to national security established in GATT, namely the one concerning measures taken in time of war or other emergencies in international relations (subsection b) iii) of Article XXI). After presenting the various disputes in which Article XXI of GATT has been alleged and the way in which GATT Contracting Parties and WTO Members have interpreted this exception, it is concluded that a proper interpretation of this provision according to WTO Agreement has to be done promptly; in order to limit potential excesses in which the Organization�s members may incur when making a self-judging of it, so it could be applied without jeopardizing the legitimacy and continuity of the multilateral trading system.Este artículo revisa la jurisprudencia relativa a las excepciones reguladas en el Artículo XXI del antiguo GATT de 1947, y también del GATT de 1994, que permitían a las Partes Contratantes del GATT, y actualmente a los miembros de la OMC, apartarse de sus obligaciones conforme al Acuerdo GATT en aras de proteger intereses esenciales de seguridad. Dentro de las excepciones relativas a la seguridad en el GATT se hace énfasis en la más controversial, esto es, la referida a las medidas aplicadas en tiempos de guerra o en caso de grave tensión internacional (inciso b) iii) del Artículo XXI). Después de presentar las diferentes disputas en las que se ha invocado el Artículo XXI del GATT y la forma como las Partes Contratantes del GATT y los miembros de la OMC han interpretado la mencionada excepción, se concluye que urge una adecuada interpretación de esta disposición conforme al Artículo IX. 2 del acuerdo por el cual se establece la OMC, con el fin de limitar los excesos en que pueden incurrir los miembros de la Organización al hacer un examen discrecional de la misma, de modo que se haga aplicable sin poner en peligro la legitimidad y continuidad del sistema multilateral de comercio
