El referendo constitucional para que el acceso al agua sea un derecho fundamental

The purpose of this paper is to analyze the socioeconomic and legal aspects that underpin the reform of the constitution via referendum, which seeks to prescribe the fundamental right to water, and indicate that the proposed provisions to the public are right to address their needs felt in this area. The central thesis of this paper is that the Colombian constitutional order requires a reform of this nature because it must honor the commitments made internationally, because Colombia has ratified the International Covenant on Economic, Social and Cultural Rights and other international treaties have obligations regarding the right to water which Colombian citizens are entitled.El objeto de esta ponencia es analizar los aspectos socioeconómicos y jurídicos que sustentan la reforma de la Constitución por vía de referendo, que pretende prescribir el derecho fundamental al agua, e indicar que las disposiciones propuestas a la ciudadanía son acertadas para resolver sus necesidades más sentidas en esta materia. La tesis central del texto es que el orden constitucional colombiano requiere una reforma de esta naturaleza porque debe honrar los compromisos adquiridos internacionalmente, pues Colombia ha ratificado el Pacto Internacional de Derechos Sociales, Económicos y Culturales y otros tratados internacionales que disponen obligaciones sobre el derecho al agua de las cuales son titulares los ciudadanos colombianos
