I advance a contextual analysis of the relationship between the domestic UK courts and the European Court of Human Rights interpretation of European Convention on Human Rights Convention rights. Aileen Kavanagh's constitution review framework and Stephen Gardbaum's commonwealth model of constitutionalism serve as the basis of my theoretical framework to analyse the relationship between the UK judiciary and the Human Rights Act 1998 and the European Court of Human Rights.
