SIR: I have the honor to transmit herewith copy of a communica,tion of 25th instant from the Commissioner of Indian Affairs~ together with a schedule giving the name:-: of the settlers upon the Crow Creek and Winnebago Reservation, in South Dakota, and the amount of damages sustained by them between February 27, 1885, the date of issuing the Executive order opening a part of said reservation to settlement and April 17, 1885, the date of the President's proclamation declaring said reservations to be uot subject to settlement, and notifying all settlers thereon to vacate within sixty days. This schedule was prepaTed by the Commissioner of Indian Affairs from the report made by Special Agent Pease, appointed under the provisions of the act of October 1, 1890 (26 Stats. 659), to ascertain these damages. The matter has been considered by the Department, as shown by the accompanying correspondence, aud it is submitted with recom-mendation for an appropriation of $116,199.19 for t,he reimbur:--ement of losses sustained by the 944 settlers covered by the schedule, and for an additional appropriation of $3,000, or so much thereof as may be necessary, to reimburse such of the 15 settlers whose claims are held for further proof as may be found entitled. Sm : I have the honor to acknowledge receipt of your letter dated January 16, 1894, replying to office report in the matter of the Crow Creek and Winnebago settlers' claims, transmitted under date of December 22, 1893, in which certain questions as to loss of time of such settler~ and of their working teams were submitted for your decision. As to the questions of such loss of time, you decided that no allow-ance hould be made therefor, and no revision of the schedules was therefore nece sary on account of said items. You decided, however, that no deduction should be made for the privilege of reentry exer-j, d by these settlers under section 23 of the act of March 2, 1889 (25 Stats., 888). It is found that 87 of the claimants exercised this privilege, and the several amounts allowed by this office in their cases have been revised in accordance with your decision. The total amount added to said 87 claims on account of said items for re"ntry is $5,930.55; adding the same to the tot al amount found to be due the 944 claimants, $110,268.64, as per former report, makes the grand total amount found to be due, $116,199.19. In aid office report, dated December 22, 1893, 15 claimants were enurn rated in upport of whose claims addit ional proofs were deemed to be necessary before the same could be allowed, and it was recom-me1Jded that such an amount, in addition to that definitely ascertained to be due the e settlers, be appropriated in order to enable this Depart-m nt to ettle the same, should they be found entitled to damages. Sm: With your letter of December 22, 1893, you submitted the report of Special Agent H. R. Pease, dated December 15, 1892, in the matter of the claims for damages of settlers on the Crow Creek and Winnebago Indian Reservations in South Dakota. You submit a very full report upon the matter, pointing out the points upon which you can not agree with the special agent, and submit for consideration and deter-mination of the Department the following questions: "First. Whether the claims for loss of time by the settlers shall be entirely disal-lowed; whether the same shall be allowed on the agent's basis, and for the amounts recommended by him, or whether the allowance shall be only for the time necessarHy lost in moving to and from the reservations-ten to fifteen days, according to dis-tance and circumstances. "Second. Whether in case it is decided to allow for loss of time, the allowance , shall be at a uniform rate per diem, and if so, the rate per diem; or whether the allowance shall be on the basis and at the rate per diem recommended by the agent. "Third. Whether or not the claims for loss of time of teams (which the agent disallows entirely) should be allowed on the i:same basis and for the same reasons as , the settler's own time, and if to be allowed, the rate per diem therefor." You express the opinion that the item for loss of time in the case of all these set-tlers should be entirely disallowed, and in this opinion I am inclined to concur. The act of October 1, 1890 (26 Stat., 659), under which these claims are made indi-cates to a certain extent the losses for which it is intended to reimburse these set-tlers. It is said: "He (the agent) shall report what improvements were made by such persons, and the section or part of section, with the townships and range upon which such set-tler made his improvements, the value of the same, the losses sustained by reason of the revocation of the Executive order opening said lands to settlement, giving the particulars of any such losses and all other facts connected therewith." This does not in my opinion contemplate the payment to such settler of wages for each day he was on the reservation. The time spent upon his claim was, . it must be presumed, utilized in making improvements and was taken into consideration in fixing the amount claimed for such improvements. If anything is to be allowed for loss of time it could be only for the time actually employed in traveling to and from said reservation, but damages of that character could be determined only by an arbitrary rule as to the time and the amount per diem. The proofs subrritted do not, so far as examined in this Department or as shown by the reports of the agent or your office, disclose facts as to this point sufficient to warrant a finding thereon. Your recommendation that the items for loss of time of the settler and of his team is approved. When these lands were afterwards opened to settlement it was provided (act of April 30, 1888, 25 St[Lt., 104, and March 2, 1889, 25 Stat., 898) that those persons who had entered upon said lands under the proclamation of the President of February 27, 1885i should have a preference right of entry for the period of ninety days for the lands thus settled upon. It was held by the special agent that the benefit thus given these settlers was a valuable one and that deduction therefor should be made from the claims of those who exercised the right thus given. He fixed the amounts to be deducted at $200 where reentry was made under the preemption laws , and at $100 where made u11der the homestead laws. You fix the amounts at $100 a-nd $50 respectively. You say: · "The deductions made on this account should therefore have been based on the value of the claimants' former improvements at the time of reentry. * -1< * These settlers were, however, saved from the necessity of participating in the rush 4 SETTLERS ON CROW CREEK .A.ND WINNEBAGO RESERVATION. in order to secure a tract of this land, and from the worry and excitement incident to the openinO' of public lands under such circumstances. This certainly was worth something to them, and should be considered in fi.x~ng the amount to be deducted." Your first statement is probably correct, but I find no proof as to the value of improvements on any tract at the time of reentry, and taking into consideration the character of the improvements I doubt if any werA of much value at the date these lands were opened to settlement in 1890. In the absence of proof I am not inclinecl to approve deductions from the claims upon this account. It is also true that these parties derived some benefit from the preference right accorded them, but there is nothing to show what that benefit was worth in dollars and cents and I do not believe the Department is justified in saying arbitrarily that a certain ~mount should be deducted from the claims made, therefor. This benefit had been conferred long before the passage of the act directing the investigation of these claims and if it had been intended to charge settlers with the advantage received thereunder such intention should have been indicated in the later act. This item should be stricken out, and the papers submitted are herewith returned that it may be done. You will prepare the schedule as herein indicated and return the papers that they may be submitted to Congress as directed in the act of October [1], 1890. Very respectfully, The COMMISSIONER OF INDIAN AFFAIRS. HOKE SMITH, Secretary. DEPARTMENT OF THE INTERIOR, OFFICE OF INDIAN AFFAIRS, Washington, D. C., December 22, 1893. Sm: I have the honor to submit herewith the report of Special .A.gent H. R. Pease in the matter of the claims for damages of settlers on the Crow Creek and Winne-bago reservations in South Dakota between the 27th day of February, 1885, the date of issuing an Executive order declaring certain portions of said reservations to be re-stored to the public domain, and the 17th ·day of April, 1885, the date of the Presi-dent's proclamation declaring said Executive order to be inoperative and void, and notifying settlers upon the lands affected thereby to remove therefrom with their e:ff cts within sixty days from the date of said proclamation. The act authorizing the ascertainment of losses sustained by such settlers was passed October 1, 1890 (26 Stats., 659). Following is a full text of said act: '' That the Secretary of the Interior shall designate a special agent of the Interior Department who shall, as soon as practicable, under the direction of the Secretary of the Interior, make inquiry and report to the Secretar y of the Interior upon the claims for losses of all persons who in good faith, between the twenty-seventh day of February, eighteen hundred and eighty-five, and the seventeenth day of April, eighteen h1mdred and eighty-five, settled upon and made claims under the land laws of the United States to any of the lands in the Crow Creek and Winnebago reser-vati ns, which by the proclamation of the President of February twenty-seventh, eiO'ht en hundred and eighty-five, were declared to be opened for settlement. Said agent shall have power to cause witnesses to come before him at some point con-venient to said reservation, and to administer oaths. He shall report what improve-m~nts were made by such persons, and the section or part of section with the town-ship and range upon which said settler made his improvements, the value of the same, the losses sustained by reason of the revocation of the Executive order opening said lands to settlement, ~iving the particulars of any such losses, and all other facts connected therewith. Said agent shall be en titled to a compensation of ten dollars per day and expenses, and may employ a clerk. There is hereby appropriated out of any moneys in the Treasury not otherwise appropriated, the sum of three thou-sand :five hundred dollars, or so much thereof as may ue necessary, The Secretary of the Interior shall transmit said report to Congress, with his recommendations thereon" In accordance with the foregoing provisions Henry R. Pease was appointed as the special agent of this Department to investigate and report the losses resulting to said settler , and under office instructions dated October 28, 1890, he entered upon the discharge of his duties about December 2, 1890. Aftor pro ecuting his investigations for two years, with a short interruption from September 30, 1891, to March 21, 1892, during which time work was suspended for want of funds, the agent submitted the papers, proofs, affidavits, and reports perta.m-ing to the several claims to this office with his general report under date of Decem-ber, 15, 1892. He remarks in said report, to which your attention is specially invited, SETTLERS ON CROW CREEK AND WINNEBAGO RESERVATION. 5-, that the number of persons who settled on the reservations, the extent of their losses, and the difficulties attending the work of a true ascertainment of the damages act-ually sustained, were not, he apprehends, fully appre0iated, either by Congress or by the Department. A majority of the settlers had remo:ved to distant parts of the Dakotas or of the United States and Canadas. To require such settlers to appear before him, with their witnesses, and make proof of their losses was imJ?racticable. , This difficulty the agent obviated by preparing blank forms for the bills of dam- , age, and depositions for the claimants and their corroborative witnesses, to be !1-l~ed out and subscribed and sworn to. These blanks were sent to the settlers res1dmg at remote points, together with a printed notice instructing them as to the ~ode of procedure. The same blank forms were also used by the agent for those claimants who appeared before him in person. Respecting these forms, which show considerable skill in their preparation, it , should be remarked that they are broad and comprehensive, and indicate a ~'ull , grasp of the subject on the part of the agent. However, the questions in the cl~1m-ant's deposition, which are intended to show that the different items in the bill of , damages are just and proper, are not as minute and particular as might be desired. The questions, for example, which bear upon the item claimed for traveling and .· transportation expenses are quite unsatisfactory in their results, as shown in a large majority of the claims. They are particularly so as to the expenses actually incurred . for transporting goods, live stock, etc. In fact the proofs in a great many instances are no index whatever to the freight and drayage bills claimed to have been pa,id. The questions should have been minute and definite as to the number of head of live stock taken to ,the reservation; the quantity (or number of loads) and approximate . weight of goods and farm implements; whether the same were sent by rail, and, if so, from and to what points, and whether by means of a hired car or as way freight; the distance by wagon to shipping point, and the distance from railroad destination to , the claim. · , Another serious omission in the deposition is that pertaining to the family of the claimant. The question, "Of whom did your family consist1" is not followed, as it should be, by one as to what members of the family accompa,nied him to the reservation, and the expense incurred for each; but it is left to be inferred that the family, if any, acaompanied the claimant, which, in most instances, it is believed, was not the case, as indicated by the amount claimed for tra¥eling. In the limited number of claims which are doubtful on this point it is, therefore, but fair to pre-sume that the bill for traveling expenses is for the entire family,and is a bona fide claim. · The question which was intended to determine whether any portion of the item for lost time was also included in any of the other items, either as labor performed by the claimant or as entering into the various items for improvements made (thus claiming double time), seems to have been ambiguous to most of the claimants, judging from the answers made thereto in a majority of the depositions. A separate item ''For --day's labor performed by myself," should have been added to the bill of damages, instead of making it a part of the item "For labor performed by myself, employes, and team." The actual number of days' time lost could then have been . readily determined, and any question as to claim for double time would have been understood. · It is not presumed, however, that the foregoing defects in the depositions should necessarily affect the claims of those settlers who appeared before the agent in person, and for whom he filled out the papers and administered the oa,ths. In those cases he had an opportunity, by means of oral questions, to enlighten himself on doubtful points, and to determine whether the various items claimed were just and proper. The several items and the amounts reported in such .claims should be approximately correct. But so far as the papers and proofs themselves are concerned, where the agent made them out, they are not on the whole any more definite or satisfactory than those made by the claimants or their agents resid-ing at remote points. The papers pertaining to the several claims seem to indicate that the work of the agent was done somewhat hastiiy. Due allowance should of course be made for the magnitude of the labor necessary to be performed, but the papers submitted show, as a whole, a lack of thoroughness and accuracy. This will appear in the review of the claims individually in schedule. It is a matter of regret that the agent did not see fit to write out an individual report for at least a large majority of the claims, such as he submits in a limited number of cases, instead of using the printed form of report which he prepared for that purpose. Of the claims presented there are but few, comparatively, that do not contain some features peculiar only to themselves, or some facts or items that should have been discussed or specially mentioned by the agent. It is doubtful whether more than two hundred of the claims were similar enough in character to have made the use of a stereotyped report fully practicable. 6 SETTLERS ON CROW CREEK AND WINNEBAGO RESERVATION. Before proceeding to consid~r t~e papers and :reports pertaining ~o t~e several . claims, as a result of the examrnat10n made by this office, your attention 1s res:pect-fully invited to a few general remarks bearing upon the allowance of some of the items of loss composing the bills of damage. . . . The laro-est single item for damages in the aggregate, and the one which 1s cl_a1med with but few exceptions, is that for time lost by the settler. As to the propriety of allowing said item this office is somewhat doubtful, particularly on the basis recom-mendeut few exceptions, for the full amount claimed. In the matter of claims for attorneys' fees, it is found after a careful review of all tbe claims, that of the total number only 257 contain an item for such fees. In other words, only a few more than one-fourth of the settlers incurred the expense of employing- an attorney to assist them in prepa,ring [md filing their papers at the local land offices. Again, of the 257 items claimed for this cause: it is found that in 36 casei3 the claims are for $25 or more, and that in 170 cases the claims are for $5 or less. The remaining 51 claims for such fees vary from $6 to $20. In the claimant's deposition the question is asked, "For what purpose did you em-ploy an attorney f" '!'lie usual answer is, '' To prepare :filing papers ;n though in a limited numl>er of cases it stated in addition that such fees were paid for advice, or for filing the papers at the local land office. Ap;ent Pease sn bmits with his general report depositions by Messrs. Clarke S. Rowe and E. I. Drury, attorney:.; in the vicinity of these settlements, in the spring of 1885, which throw some light on the question of attorneys' fees ch arged these settlers at that time. From them it appears that the price for making out the necessary papers was $2, and that where such papers were tendered at the land office by the attorney the charges were $25. In his general report the agent says that the settlers in many cases employed an attorney to carry their papers to the land office, as the settler was compelled to remain on his claim to protect his property against theft and destruction. In view of the limited number of cases in which the extra fees were paid for s::i.id purpose, the office is inclined to doubt its necessity altogether. At any rate the Government wa in no way responsible for the alleged state of lawlessness which made it necessary to incur such additional expenses . pon informal inquiry at the General Land Office it is learned that the practice among settlers of employing an attorney to prepare their :filing pap1:,rs is quite gen-eral, it being done in probably one-third of the cases; aud that the usual fees for su ·h work are $2 or $3. In view of all the facts this office is inclined to believe that it is customary to a certain extent to employ an attorney to prepare :filing papers; and that wllere such employment is alleged in these claims the same was n ecessary. The employment, how ver, of an attorney by a small number of these settlers, either for counsel or for the purpose of tendering the filings in their behalf, was, it is b elieved, both unusnal and unnecessary; and the payment of attorney's fees for such purposes, exoruitaut, as they douutless were in most cases at that time, was a matter entirely within the <'li cretion of the settler and one for which the Government can not, in the opinion of this office, be properly held responsible. · In matters of this nature, what is customary and usual must be taken as a guide. Th offi e ha , therefore, allowed for attorneys' fees only such an amount as will uffice to r imburse the ettlcr for having his :filing papers prepared. Though it app ars that $2 (or $3 at the most) is the usual fee for snch work, the settler h as been giv n tho benefit of any ably not more than $75, and 1t 1s fair to presume that the same had, to a large extent, disappeared at t he time of settlement in 1890. 'I'hese settlers were, however, saved from the necessit y of participating in the rush in order to secure a tract of this land and from the worry and excitement incident t o the openjng of public lands under such cir cumst an ces. This certainly was worth something to them and should be considered in fixing the amount to be deducted. The office has fixed upon $50 and $100, r espectively, for homestead and pre-emption reentries as a fair value of t he benefits thus conferred upon this class of settlers. It should be added in this connection that the preemption laws had been repealed subsequent to the time of making these settlements in 1885, and that by being permitted under said act of March 2, 1889, to make preemption entries these settlers were enabled to save their homestead right for use at some future time. It frequently occurs that settlements by two and even three settlers are alleged to have been made on the same tract, all of t hem claimiug damages for losses sustMned by reason of such settlement. Respecting these conflicting claims the office has sus-tained the agent in his view of the same, and h as allowed them all, provided t he claims are in other respects proper. No filings for these lands were accepted by t h e local land officers during t he period in question, and there was, therefore, no proper tribunal for hearing and determining the rights of the several claimants. Mention should be made of the fact that the agent allowed, either as a whole or in p art, the claims of 16 alleged settlers who located upon lands, according t o the descriptions submitted, that wer e not affected by the Executive order of .February 27, 1885. They were either outside the old reservations on lands already forming a part of the public domain, or inside the tract thrown open to settlement on lands that wer e reserved to the Indians by that order. All these claims the agent has passed without making any comment on this point, though the claims for damages, if the d escriptions of the tracts sub-mitted are correct, are clearly improper and shoul d have been disallowed. The agent submitted with his report a map, which he had prep ar ed for his guid-ance, showing the boundaries of the Crow Creek an d Winnebago r eservat ions prior to the order of February 27, 1885, and also the boundaries of the diminished reser -vations as e tablished by that order. From said map, which has b een verified as to its correctness by the draftsman of this office, it can be r eadily determined whether the several claimants located upon lands affected by the order of February 27, 1 85. A uminrrthaterrors might have been made by t h ese claimants indescribingtheir lands, and that the same had escaped the atten t ion of the agent , this offi ce gave them the benefit of any doubt on that point. Under dates of Aug us t 31 and Septem-ber 1, last, they were notified as to the status of their claims, and directed t o sub-mit corrected descriptions and additional proofs bearing thereon, if errors had been mad in their former descriptions. They were informed that their claims would be disallowed unless satisfactory evidence as to the location of their r espective t racts were submitted. p to the pre ent time only two replies have been r eceived to said letters, one of which is favorable to the claimant. The status of t h ese claims will be considered further in connection with the reports on the individual claims. Th claims of the North Chamberlain townsite settlers, about 4.5 in number, whi h the agent has intermixed with the others should, for the sake of greater con-ve;11ience, h:3ive been submitted in a class by themselves. For a concise history of said town 1te settlement and the status of the lands upon which t he same was located, at1 ention is invited to the portion of Agent Pease's report bearing upon the subject. This office concurs in his opinion that, wherever t he title to f!aid townsite lands may have rested at that time, the l:lettlers thereon entered in good faith and are equitably entitled to reimbursement for the losses sustained. THE REPORTS ON THE SEVERAL CLAI MS. The reports of this office upon the several claims have, for the sake of conciseness and great r convenien e, been arranged in the form of a schedule showing the num-ber anJ name of claimant (arranged alphabetically,) the dates of settlement and removal, descriptions of lancls located upon, the total amount of losses claimed, the total amount of losses allowed and recommended to be paid by t he agent, the num-ber of day ' time lost by the settlers as found b y the agent, and the amoun he allow therefor, and the total amount allowed by the Indian Office. Such remarks have also been added as were deemed pertinent, or as were necessary to elucidate the several amounts allowed. It was thought advisable to give the number_ of days lost in order to indicate the rate per diem a-llowed by the agent, and also m order that the allowance for such time could be easily determined in case it is decided by the Department to recommend the allowance of a wniform rate per diem. He also recommends disallowance of item for lost time. Both the items for lost time and for travel-ing are no doubt included in the bill of May 18, 1885, for $415 alleged losses; thus both these items are im-proper on agent's basis. (See Exhibit .A. and agent's report.) In present bill improvements valued at$293.50 are alle~ed, while in t,he a.ffidavit of 1885 above-roen-tionetl tney were only valued at $165. No doubt the statement made in 1885 is nearest to the true valua-tion, and the $415 was intended to include all losses and expenses incurred up to tlrnt time. Indian Office deducts from saicl $H5 the $35 claimed in present bill for loss of time, leaving a balance of $380. This is a liberal allowance in view of the fact 1bat claimant was a trespasser for two years a,nd enjoyed use of his im-provements. Claim of $500 for loss of preemption rig-ht is very properly disallowed by agent. 1 Claimant did not remove till May 10, 1887. .A.gent seems to be inconsistent in allowing for lost time. He allows such loss in this case without comment, though as a rule be does not allow therefor where claimant re-mained several months or more after time to vacate.
