The eastern boundary of the ioux: comw nee opposite th mouth of Ioway River, on the Mississippi, runs back 2 or 3 miles to the bluffs, follows the bluffs, crossing Bad Axe River, to the mouth of Black River, and from Black River to half a day's march below the falls of the Chippewa River. (a) .As indicated, this treaty simply establi hed boundaries and settled differences between the several tribes interested, and no annuities or payments were guaranteed to them under it. TREATY OF JULY 15, 1830 (7 STATUTES, 328). This treaty was made with the confederated Sacs and Foxes; the Medawakanton, Wahpakoota, Wahpeton, and Sisseton bands of Sionx; the Iowas, Omahas, and Ottoes and Missourias, and by article I tl.ieir right and title to the foJlowing lauds were forever relinquished: Beginning at the upper fork of the Demoine River and passing the sources of t he Little Sioux and Floyds rivers to the fork of the :first creek which falls into the Big Sioux or Calumet on the east side; thence down said creek and Ca.lumet Hiver t o t he Missouri River; thence down said Missouri River to the Missouri State line, above the Kansas; thence along said line to the northwest cornPr of the said State, thence to the high lands between the waters falling into the Missouri and Desmoines. pa s ing to said high lands along the dividing ridge between the forks of the Grand Ri ver; thence along said high lands or ridge Sf\pa:mting the waters of the iissouri from those of the Demoine to a point opposite the source of Boyer River, and thence in a direct line to the upper fork of the Demoine, the place of beginning. (a) Of this cession, however, only the land north of the Sac and Fox boundary line, as shown on the map and embraced in diagram IB, was claimed or owned by the Sioux. By article 3 the Medawakanton, Wahpakoota, Wahpeton, and Sisse-ton bands ceded and relinquished to the United States forever ''a tract of country 20 miles in width from the i.\lississippi to the Demoiue River, situate north and adjoining the line mentioned in the preceding arti-cle'' (cession by the Sacs and :Foxes).-(b) .A tract of land was set apart by article 9 for the half-breeds of the said four bands of Sioux within the following limits: Beginning at a place called the barn, below and near the village of Red Wing Chief~ and running back fifteen miles; thence in a parallel line with Lake Pepin and the ML si sip pi, about thirty-two miles to a point opposite Beef or 0-Boeuf River; thenco fifteen miles to the Grand Encampment, opposite the river aforesaid; the United States agree to suffer said 1ialf breeds to occupy said tract of country, they holding by the same title and in the same manner that other Indian titles are held." (c) .A further tract was set apart by article 10 for the half-breeds of the Omahas, Iowas and Ottoes, and the Yankton and Santee bands of Sioux, bounded as follows: Begiuning at the mouth of the Little Ne-mohaw River and running up the main chanu el of said river to a, point which will be ten miles from its mout,h in a direct line, from thence in a direct line to strike the Gr:1Uu Ne-mohaw t en miles above its mon th in a direct line (the distance between the two Ne-mohaws beino- about twenty miles); thence down said river to its moutli; thence up and with them~anders of the lissouri River to tho point of beginning. (a) By article 11 it appears that the land represented in the preceding article "as owned exclusively by the Ottoes, and it was agreed that the Omahas, the lo'l-ras, and the Yankton and Santee bands of Sioux should pay them therefor out of their ~nnuities. This <;onclusion seems war-ranted by the fact that their half-breeds went with their brethren (tbe Ya11ktons) to the Nemaha reserve, (a) while tl.10se provided for in article 9 went to the Lake Pepin reserve. (b) But two of the Sissetons and none of the Wahpetons were signers of this treaty. Two thousand dollars per annum, either in money, merchan-dise, or domestic animals, were guaranteed by the treaty; also agricul-tural implements, iron and steel, to an amount of $700, and a blacksmith, with necessary tools, for the same period, and as long thereafter as the President of the United States might think necessary and proper. (c) TREATY OF NOVEMBER 30, 1836 (7 STATUTES, 527). The chiefs, braves, and principal men of the Wahpakoota, Sisseton, and Upper Medawakanton tril>es of Sioux ceded, relinquished, and quitclaimed to the United States all their "right, title, and interest of what, oever nature in and to the lands lying between tbe State of Missouri and the Mi souri River," (d) and exonerated the United States from any guarantee, condition, or limitation, expressed or implied under the treaty of 1830, as to the entire and absolute disposition of the lands then ceded, '' fully authorizing the United States to do with the same whatever shall seem expedieut or necessary." Other trfoe ceded the same laueII, for valuable services rendered. ~fhe ninth clanse of the . econd artiele and the third article of the t reaty were 8tricken out before ratification by the United States Senate. Tl1 is trea,ty, therefore, provided for the iuvestment of 300,000, at 5 per crnr, i11terest; for payments amounting to $216,000; for annuities amon11ting to $23,750 for twenty years, and for $15,000 per annum t l1ereafter. Appropriation of $216,000, to make payment for the· objects above s tated, was made· by the act of July 7, 1838, and interest and annuities to t he amount of $38,750, were provided annually up to and including t he fiscal year 1857 (appropriations for two years having been credited on t ile books of the Indian Office in 1843), making twenty yearly install-ment s, omitting, however, olle-half of the $8,250 for the purcha e of implements, etc., in the year 184:~, aggregati11g $770,875. Appropria-t iou of $15,000 interest per annum on .,. 300,000 was continued, includ-ing the fl.seal year 1863 and part of 18<:l4, making six and two-tllirds year s, and amounting to $100,000. The total value of the above-named interest ·and ammities for twenty years and the $15,000 interest for six and two-thirds years more is $875,000. The total amouut appro-priated for the period stated wa~ $870,875, leaving a balance of $4:,125 apparently due. Au appropriation of $42,841.47 was made by the act of l\iarch 3, 1857 (11 Stntutes, 183 ), to restore '-the legitimate balance found due the lVIedawakanton ar,d \.-\"ahpakoota Sioux, under treaties of 1830 and 1837, for moneys heretofore carried to the surplus fuud." This appropriation also covers the aforesaid a.pp~ren t shortage of $4,1~5, as per letters of the Commi siouer of Iudian Affairs, dated April 8, and May 27, 1856, to the Secretary of the Interior. (Indian Office files, Report Book No. 9, pp. 277 and 322). All of these fuuds were faith-fully expended for the beuefit of the Indians, prior to July 1, 1862, excepting the last appropriated installment of $15,000 interest, pro-v ided for the fiscal year 1863, which was suusequently disbursed under t he provisions of the forfeiture act of 18u3. (a) TREATY OF AUGUST 5, 1851 (10 STATUTES, 954). By article 2, the Medawakantons and Wahpakootas (and the Sisse-tons and Wahpetons also, by their treaty of July 23, 1851), "cede and relinquish all their ]ands and a11 rigllt, title, a11d claim to any Jauds whatever, in the Territory of Minnesota, or in tlie State of Iowa.'' (u) In part consideration of the foregeillg- cession, the United States set apart for their future occupancy and borne, "to be held by them as Indian lands are held, a tract of couutry of t.he average width of 10 miles on either side of the Minnesota H.iver, and bounded on the west by the Tcl1aytambay and Yellow Medicine rivers, and on the east by tlie Little Rock l~iver, and a liuc running due south from its mouth to the Waraju River'' (art. 3). (b) In further and full consideration of said cession (art. 4), the United States agreed to pay them $1,410,000, at the eyeral times, and in t,he manner and for tbe following purposes: Fir t. States. Second. Thirty thousand dollars for the establishment of manual-labor cboolR, erect.ion of mills and blacksmith shops, opening farms, feucing, and breakiug land, and for other beneficial purposes. The balance of the aforesaid $1,410,000 ($1,160,000) was to remain in tru t with the United States, and 5 per cent interest thereon paid annually for tlie period of fifty years, commencing July I, 1852, "wbich sliall be in full payment of said balance, principal and interest," to be applied as follows: Thirct. Twelve thousand dollars for a general improvement and agri-cultural fund. F ourth. Six thousand dollars for educational purposes. ] ifth. Ten thousand dollars for purchase of goods and proviRions. Sixth. Thirty thousand dollars for money annuity. These payments aggregated $58,000 per annum. A payment of $150,000 was provided by the eighth article of the treaty, to be made to the half-breeds who failed and refused to avail themselves of the provisions for their benefit in the ninth and tenth articles of the treaty of July 15, 1830, to be in lieu of the tracts of land then set apart for tbem. Thi article of the treaty was stricken out by the Senate on June 23, 1852, when before that body for ratification. Article 3 wa also stricken out at the same time, and in lieu of the land et apart by that article for the occupancy aud home of the Indian a tipulation wa, inserted to pay them at the rate of 10 cents per acre for the lands included in that reservation, and, further, the Pre iy the military forces of tlle Governn?ent and confined at variou I lace , prin-cipally at Davenport, Iowa, and no further expenditure for their ca re or , upport were ma le until arrangements bad b en completey the Department. TREATY OF JUNE 19, 1858 (12 STATUTES, 1031). Article 2 of this treaty provided that a part of the lands described in the original thir(l article of the treaty of 18.31, which were sub e-quently confirmed to the Indians by the act of July 31, 1854 (10 Statutes, 326), as a permanent r serva.tion (tlte Indiaus having been permitted to remain thereon and occupy the same (a,) and not required to remove to other lands, as provided by the ameudmeuts to the treaty of 1851), were ceded to the United State , leavi11g to the Senate of the United States the que tion wbetlrnr they honld be allowed a specific sum of money therefor, and if so, how much; or whether the same should be old for their beuefit, they to receive tbe proceeds of the sale after deducting the expeu e ' attendant thereon. (b ) The Senate, by resolution dated June 27, 1860, determined that the Indiau "be allowed the sum of thirty cent per acre for the lands con-tained iu that portion thereof (the re ervation) lying on the uorth side of the Minne ota River, exclu ive of the co t of survey and sale, or any continO'ent expen ' e that may accrue "'hatever, which by the treatie of Jun , 185 , they have relinquished aud given up to the United tates'' (12 Statute , 1042). Thi amount appears to be a proper charge again t the Indians in any future adju tment of their a count. Thi compri e all the financial tran actions of these bands up to the date of their rebellion again t the authority of the Government. After a See map, diagrams 9 and 10. b See ruap, diagram 10, c See statement o. 4:, SIOUX INDIANS. 9 their subjugation and the col1ection of a portion of their membership on the Crow Creek Reservation ( a), in 1 '63 and subsequent years, where they remained until some time in 186G, they, with a portion of tbe Sis-seton and W abpeton bands, were up ported by direct appropriations made by Congress, until tlieir removal to the iobrara or Santee Res-ervation (b) in the State of ebra .. Irn, on wbich reservation tJrny have since remained and been known a' the Santee Sioux or Santees. 1his reservation comprises 72,914.40 acres. Appropriations for the remornl, location, a.11d support of tbe four bands, and for damages caused by their outbreak, were made from tirne to time, between l\Iarch 3 L. 63, and March 3, 1885, aggregating $1,849,G60.0l, of which $1,778,709.48 was expended in the payment of such expenses, and the balance, $70,950.53, returned to the Trensnry. (c) These expenditures became necessary because of tlle concerted aud united action of the four bands. No diff~rence in degree of liability for the acts committed by tllem has ever been recognized, and it would appear that each brauch i JiabJe for its proportion-$889,354.74. Other appropriations were made for their support after their removal to Nebraska, aggregating 50,000 ( d), of which $46,300.05 was expe11ded for that purpo~e, and $3,G99.95 carried to the surplus fund. An appro-priation of $15,000(d) was also made to pay damages1mstained by citi-zens of Nebraska, because of locating the Santees on their lands, $11,612.93 thereof being expended in the payment of said damages, aud $3,387.07 was also carried to the surplus fund. The so-caned forfeiture or confiscation act of February 16, 1863, so far as it affected the landed interest.:s of these band .. , had such force or effect only in theory, as the lands in .:\linnesota belouging to them were subsequently sold by authority of Congress, and the proceeds devoted to their use. SIOUX RESERV .A.TIONS IN MINNESOTA .A.ND DAKOTA. (.A.ct of March 3, 1863, 12 Statutes, 819.) By this act Congress authorized the sale of the reservations in J\fin-nesota and Dakota belonging to the four bands, and the use of the proceeds for the benefit of the Indians in their new homes, in estab-li~hing them in agricultural pursuit8. ( e) A survey of these reservations was made in 1865, by which it appears that there were 721.172.65 acres-606,065.05 in Mi1rnesota and 115,107.60 in Dakota-and the apprai:-ed valuation thereof was $941,218.31. It was subsequently ascertained that the survey in Dakota was incorrect, and another was made in 1882, by which it was a certained that tbe area was 131,018.98 acres; but these lands were not reappraised. The books of the General Land Office il1dicate tbat sales have been made under the original survey. Sales have been made amounting to 944,810.78, including interest on deferred payments, aud '934,415.61 have been expended, leaving a balance of $10,395.17 on hand. By· section 7 of the act of that date (16 Statutes, 3ul) it was provided-That the act approved March three, eighteen hundred and sixty-three, entitled ''An act for the removal of the Sisseton, Wahpeton, Medawakanton, and v\ abpa-koota bands of Sioux or Dakota Indians, and for the disposition of their lands iu Minnesota and Dakota," be so amended as to make the proceeds of the sale of the reservations in sai'e at Devil' Lake-it being e timated tbat there were 1,500 of the former and 1,000 each of the two latter, 3,500 in all. The ·e proportion have since been maintain din dividing the proceed of these lands. 'rhe prece ling conclude the bi 'tory of the financial aud lauded oper-ation of the Medawakantou an67,370.21 duriug that time, twenty-seven years, from funds provided by the Government. Of the total amount expended $1,771,618.90 have been for the antet-s proper and $302,219.23 for the-Fla11dreau . The latter recei\'ed money in lieu of laud (act of August 19, U,90, 26 Statute , 349), as did ome of tue Santees who were unable to select lands on their re ervation (acts of January 19, 1 91, 26. Stat-utes, 720, and July 13, 1892, 27 Statutes, 145). SUBSISTENCE SUPPLIES. The value of the subsL tence furnished tlle Santees since their loca-tion on the reservation in ebraska is 560,953.44, which includes also the value of sub ' istence furnished the Flandreaus since their separation from the main body. Inasmuch as the Santees and the Si setous and Wabpetons were provided for as a whole while on the Crow Creek Reservation, in Dakota, from some time in l t 63 to their separation in 1866, and the removal of the former to Nebraska, it is impracticable to state definitely the value of the subsistence furnished either branch during that period. UNPAID ANNUITIES. ·.rhe amount of unpaid annuities under the treaties of 1830 and 1837, including $300,000 iu principal under the treaty of 1837, confiscated by the act of February 16, 1863, is $3,052,792.83. (a) MEDA W AK.ANTONS IN MINNESOTA. A few members of this band, numbering twenty-three families in 1887, who were partie-• to the treaty of 1851, and who were reputed to be friendly to the whites during the war period of 1862, and became scattered over the State of Minnesota, and never thereafter settled upon any reservation, have received aid from the Government, begin-ning in 1884, to the extent of $70,739.66. (b) This amount has been expended in small per capita payments to them and in the purchase of land in Minnesota, upon which they have located, and for agricultural implements, seeds, cattle and horses, and small quantities of food and clothing when necessary. An available balance of $2,500 of the appropriation for their benefit for the fiscal year 1898 remains on the books of the Jndian Office. It is presumed that this sum will be needed for per capita payments to them, and will make the total expenditure for their benefit $73,2:-rn.66. From a review of the several treaties with the Medawakantons and the W ahpakoota it appears that no cessions were made by the treaty of 182.5. By the treaty of 1830 these bands, with the Sissetons and Wahpe-tons ,rnd other tribes, ceded all their rig-ht and title to the tract of land described in article 1, ( c) and by article 3 the four bands ceded a tract 20 mil s wide, from the Mi sissippi River to the Demoi11e River, (d) in consideration of an annuity of 2,000 for ten years, with other allow-ance pecifieancy therein in tlrn State of 1Vliu11esota were collected under the provisions of the act of March 0, 1863, a nd located ou th Crow Creek Reservation in Dakota, (a) where they rernaiued until their final location in the State of ebraska.(b) :ro iutere tin lands wa acquired under the provisions of tlie treaty of 1SG8 or the agreement of 1877. ARTICLE 9. The county secured to the Ottawa, Chippewa, and Potawatomie tribes of the Illinois, is bounded as follows: Beginning at the Winne-bago village, on Rock river, forty miles from its mouth, and runniug thence down the Rock river to a Hue which runs from Lake Michigan to the Missis ippi, and with that line to the l\Iississippi, oppo ite to Rock Island, thence up that river to the United States reservation, at the mouth of the Ouisconsin; thence with tlie south and east liues of the aid re ervation to the Oui con sin; thence, southel'ly, passing the beads of the small streams emptying into the Mi si 'Sippi, to the Hock river at the ·winnebago village. The Illinois Indians have al ·o a just claim to a portion of the country bounded south by the Indian boundary line afore aid, running from the southern extreme of lake Michigan, east by lake Michigan, north by the Menominie country, and north-west by Rock river. This claim is recognised in the treaty concluded with the said Illinois tribes at St. Louis, August 24, 1816, but as the Mille-wakee and fanetoowalk bands are not represented at this Council, it cannot be now definitively adjusted. ARTICLE 10. AU the tribes aforesaid acknowledo-e the general contro1ing power of the United tate , and di claim all dependence upon, and connection with, any other power. SIOUX I "DlANS . .ARTICLE 12. 25 The Chippewa tribe being dispersed over a great extent of conntry, and the Chiefs of tllat tribe ·haviug reque ted that such portion of them as may be thought proper, by the Government of the niterl Sta,tes, may be assembled in 1826, upob some part of Lake Superior, that the objects and advantages of this treaty may be fully explai11ed to them, so that the stipulati011s thereof may be ob erved by the warriors, the Commissioners of the nited States assent thereto, and it is therefore agreed that a council shall accordingly be held for these purpo~es . .ARTICLE 13. It is understood by aJl the tribe , parties hereto, that no tribe shall hunt within the acknowledged limits of a11y other without tlieir assent, but it being the sole o~ject of this arrangement to perpetuate a peace among them, and amicable relations bei11g now restored, the Chiefs of all the tribes have expressed a determiuat.ion cheerfully to a11ow a reciprocal right of hunting on the lands of one another, permission being first asked and obtained, as before provided for . .AR'.I.'ICLE 14. This treaty shall be obligatory on the tribes, parties hereto, from and after the date hereof~ and on the United States, from and after it8 rati-fication by the government thereof. ART. IV. In further and full consideration of said cession and relin-quishment, the United States agree to pay to said lnclians the sum of one million four hundred. and ten thousand dollars ($1,410,000,) at the seyeral times, in the man11er and for the purposes following, to wit: 1st. Mix, commissioner, ou the part of the United States, and the following named chiefs aml heaa and Yellow Medicine rivers, which land was to "be held by said bands iu common." SIOUX INDIANS. 49 And whereas the Senate of the United States so amended said treaty as to strike therefrom the provision setting apart said laud as a home for said bands, and made provision for tl1e paymeut to said bands "at the rate of ten cents per acre for the lands included in the" said tract so reserved and set apart for the" occupancy and home" of said bands, and also provided, in addition thereto, that there should be " set apart, by a1)propriate landmarks and boundaries, such tracts of country with-out the limits of the cession made by the first article of tbe" said treaty as should "be satisfactory for their future occupancy and home," said Senate amendment providing also "that the President may, with the consent of these Indians, vary the conditions aforesaid, if deemed expe-dient;" all of which provisions in said amendment were assented to by said Indians. And whereas the President so far varied the conditions of said Sen-ate amendment as to permit said bands to locate for the time being upon the tract originally reserved by said bands for a home, and no '' tracts of country without the limits of the cession" made in the said treaty has ever been provided for or offered to said bands. And whereas by the '' act making appropriations for the current and contingent expenses of the Indian department and for fulfilling treaty stipulations with various Indian tribes," approved July 31, 1854, the President was authorized to confirm to the Sioux of Minnesota forever the reserve on the Minnesota river now occupied by them, upon such conditions as he may deem just. And whereas, although the President bas not directly confirmed said reserve to said Indians, they claim that as they were eutitled to receive "such tracts of country" as should "be satisfactory for their future accupancy and home," and as no such country bas been provided for or offered to said bands, it is agreed and stipulated that the question shall be submitted to the Senate for decision whether they have such title; and if they have, what compensation shall be made to them for that J)art of said reservation or tract of land lying on the north side of the Minnesota river-whether they shall be allowed a specific sum of money therefor, and if so, how much, or whether the same shall be sold for their benefit, they to reeeive the proceeds of such sale, deducting the necessary expenses incident thereto. Such sale, if decided in favor of by the Senate, shall be made under and according to regulations to be prescribed by the Secretary of the Interior, and in such manner as will secure to them the largest sum it may be practicable to obtain for said land. ARTIOLE 3. It is also agreed that if the Senate shall authorize the land designated in article two of this agreement to be sold for the benefit of the said Mendawakanton and Wabpakoota bands, or shall prescribe an amount to be paid said bands for their interest in said tract, pro-vision shall be made by wl1ich the chiefs and headmen of said bands may, in their discretion, in open council, authorize to be paid out of the proceeds of said tract such sum or urns as may be found necessary and proper, not exeeeding seventy thousand dollars, to satisfy their just debts and obligations, and to provide goods to be taken by said chiefs and headmen to the said ba11ds upon their return: Provided, h01cever, That their aid determinatio11s shall be approved by the superintendent of Indian ~ft'air for the norther~ superintendency for the time being, and the aul payment be authorized by the Secretary of the Interior. ARTICLE 4. The land retained and to be held by the members of the Mendawakanton and Wahpakoota bands of the Dakota or Sioux Indians, S. Doc. 67--4 50 SIOUX INDIANS. under and by virtue of the first article of thi~ agreement, shall, to aJl intents and purposes whatever, be deemerl and held to be an Indian re ervation; and the laws which have been or may hereafter be enacted by Oougress to regulate trade and intercourse with the Indiau tribes shall have full force and effect over and within the limits of the same; and no person other than the members of the said ba11ds, to be ascer-tained and de.fined under such regulations as the Secretary of the Interior shall prescribe, unless such as may be duly licensed to t rade with said bands, or employed for their benefit,, or members of the fam ily of such persons, shall be permitted to reside or make any settlement upon any part of said reservation; and the timbered land allotted to individuals, and also that reserved for subsequent distribution as pro-vided in the first article of t.his agreement, shall be free from all tres-pass, use, or occupation, except as hereinafter provided. ARTICLE 5. The United States shall have the right to establish an d maintain upon said reservation such military posts, agencies, schools, mil1s, shops, roads, and agricultural or mechanical improvements, as may be deemed necessary, but no greater quantity of land or timber shall be taken and used for said purposes than sliall be actua1ly req nisite therefor. And if, in the establishment or maintenance of such posts, agencies, roarls, or other improvements, the timber or other property of any individual Indian shall be taken, injured, or destroyed, .inst, and adequate compensation shall ue made therefor by the United Sta tes. Roads or highways authorized by competent authority other than the. United States, the lines of which shall lie through said reservation, shall have the right of way through the same, upon the fair and just value of such right being paid to the said Mendawakanton and ,vah-pakoota bands by the party or parties authorizing- or interested in the same, to be assessed and determined in such manner as the Secretary of the Interior shall direct. R'l'ICLE 6. The Mendawakanton and Wahpakoota bands of Dakota or Sioux Indians acknowledge their dependence on the government of the United States, and do hereby pledge and bind themselves to pre-serve friendly relations with the citizens thereof, and to commit no injuries or depredat~ons on their persons or property, nor on those of the members of any other tribe; hut in case of any such injury or depre-dation, full compensation shall, as far as practicable, be made therefor out of their moneys in the hands of the United States; the amount in all case, to be determined by the Secretary of the Interior. They further pledge themselves not to engage in hostilities with the Indians of :my other tribe unless in self-defense, but to submit. through their agent, an matters of dispute and difficulty between themselve ' and other Indians, for the decision of the Pre ideut of the ui ted tates , and to acquiesce in and abide thereby. They ahm agree to deliver to the proper officers all persous belonging to their said band · who ma.y become offenders against the treaties, laws, or regula,t ions of the United t ates, or the laws of the Stat of Minne 'Ota, and to assist in discover-ing, pursuing, and capturing an such oftenp.er whenever required so to do by such officers, through the agent or other proper offi cer of the Indian department. ARTICLE 7. To aid in preventiug the evils of intemperance, it is hereby tipulated that if any of the members of the aid Mendawakan-ton and Wabpakoota bands of Sioux Indians shall drink, or procure for others, intoxicating liquors, their proportion of the annuitie of said bands shall, at the discretion of the Secretary of the Interior, be with-held from them for the period of at least one year; and for a violation SIOUX INDIAN$. 51 of any of the stipulations of this agreement on the part of any mem-bers of said bands, the persons so offending shall be liable to have their annuities withheld aud to be subject to such other punishment as the Secretary of the Interior may prescribe. ARTICLE 8. Such of the stipulations of former treaties as provided for the payment of particnJar sums of mouey to the said J'lfolHlawakan-ton and Wahpakoota bands, or for the application and expenditure of specific amounts for particular o~jects or purposes, shall be, and hereby are, so amended and changed as to invest the Secretary of the Interior with discretionary po-wer in regard to the manner and objects of the annual expenditure of all such sums or amounts which have accrued and are now due to said bands, together with the amount the said bands shall become annually entitled to under and by virtue of the pro-visions of this agreement: Provided, The said sums or amounts suall be expended for the benefit of said bands at such time or times and in such manner as the said Secretary shall deem best 0alculated to promote their interests, welfare, and advance in civilization. And it is further agreed, that such change may be made in the stipulations of former treaties which provide for the payment of particular sums for specified purposes, as to permit the chiefs and braves of said bands or any of the subdivisions of said bands, with the saHction of the Secretary of the Interior. to authorize such payment or expenditure of their annuities, or any portion thereof, which are to become due hereafter, as may be deemed best for the general interests and welfare of the said bands or subdivisions thereof. ARTICLE 9. As the Senate struck from the treaty with the Menda-wakanton band of Sioux of the twenty-ninth day of September, one thou~and eight hundred and thirty-seven, the ninth clause of the second article and the whole of the third article of said treaty, which provided for the payment of four hundred and fifty (450) dollnrs annuaJJy, for twenty years, to Scott Campbell, and confirmed to the said Scott Camp-bell a tirle to five hundred (500) acres of land which he then occupieci, said payment and laud being deemed by said Indians to form a part of the consideration for which they ceded to the United States a certain tract of la11d iu said treaty specified, which reduction, in the considera-tion for said land, llas never been sanctioned by said Indians, the said Menda~rnkantons and Wahpakoota bands now reque t that provision be made for the payment of the sum of ten thousa11d (10,000) dollars to A. J. CampbeU, the son of said Scott Campbell, now deceased, in full consideration of the money stipulated to be paid and lanad men among the white., or among other people subject to the authority of the United States, sl1all commit any wrong upon the person or property of the Indian , the United States will, upon proof made to the agent and forwarded to the Commissioner of Indian Affairs at Washington city, proceed at once to cause the offender to be ar-rested and punished according· to the laws of the United tates, and also reimburse the injured per, on for the loss sustained. If bad men among the Indians shall commit a wrong or depredation upon the person or property of any one, white, black, or Indian, subject to the authority of the United States, and at peace therewith, the Indians herein named solemnly agree that they will, upon proof made to their agent and notice by him, deliver up the wrong-doer to the Uuited States, to be tried and puni hed accordi11g to it laws; and in ca e they willfully refuse so to do, the person iujured shall be reim-bur ed for his loss from the annuities or other moneys due or to become due to them under thi or other treatie made with the United State . The United States agrees that the following district of country, to wit, viz: commencing on the east bank of the Missouri river where the forty-sixth parallel of north latitude crosses the same, thence along· low-water mark down said east bank to a point opposite wllere the northern line of the State of .Nebraska strikes the river, thence west across said river, aud aloi1g the northern line of Nebraska to the one hundred and fourth degree of longitude west from Greenwich, thence north on said meridian to a point where the forty-sixth parallel of north latitude intercepts the same, thence due east along said parallel to the place of beginuing; and in addition thereto, all existiug reser-vations on the east bank of said river shall be, and the same is, set apart for the absolute and undisturbed use and occupation of the Indians herein named, and for such other friendly tribes or individual Indians as from time to time they may be willing, with the cousent of the United States, to admit amongst them; auroken pair of American oxen within sixty days after such lodge or family shall have so settled upon aid reservatiou. ---- :--:::-:-:-------------------------* The words "or before," are inserted with black pencil. 58 SIOUX INDIANS. ARTICLE XI. In consideration of the advantages and benefits conferred by this treaty and the many pledges of friendship by the United States, the tribes who are parties to this agreement hereby stipulate that they will relinquish all right to occupy permanently the territory outside their reservation as herein defined, but yet reserve the right to bunt on any lauds north of North Platte, and on the Republican Fork of the Smoky Hill river, so long as the buffalo may range thereon in such numbers as to justify the chase. And they, the said Indians, further expressly agree: 1st. That they will withdraw all opposition to the construction of the railroads now being built on the plains. 2d. That they will permit the peaceful construction of any railroad not passing over their reservation as herein defined. 3d. That they will not attack any persons at home, or travelling, nor molest or disturb any wagon trains, coaches, mules, or cattle belonging to the people of the United States, or to persons friendly therewith. 4th. They will never capture, or carry off from the settlements, white . women or children. 5th. They will never kill or scalp white men, nor attempt to do them harm. 6th. They withdraw all pretence of opposition to the construction of the railroad now being built along the Platte river and westward to the Pacific ocean, and they will not in future object to the construction of railroads, wagon roads, mail stations, or otber works of utility or necessity, which may be ordered or permitted by the laws of the United States. But should such roads or other works be constructed on the lands of their reservation, the government will pay the tribe whatever amount of damage may be assessed by three disinterested commission-ers to be appointed by the President for that purpose, one of said com-missioners to be a chief or beadm:m of the tribe. 7th. They agree to withdraw all opposition to the military posts or roads now established south of the North Platte river, or that may be established, not in violation of treaties heretofore made or hereafter to be made with any of the Indian tribes. ARTICLE XII. No treaty for the cession of any portion or part of the reservation herein described which may be held in common, shall be of any validity or force as against the said Indians unless executed and signed by at least three-fourths of all the adult male Indians occupying or interested in the same; and no cession by the tribe shall be understood or con-strued in such manner as to deprive, without his consent, any individ-ual member of the tribe of his rights to any tract of land selected by him, as provided in article VI of thi treaty. ARTICLE XIII. The United States hereby agrees to furnish annually to the Indians the physician, teachers, carpenter, miller, engineer, farmer, and black-smiths, as herein contemplated, and that such appropriations shall be made from time to time, on the estimates of the Secretary of the Interior, as will be sufficient to employ such persons. SIOUX INDIANS . 59 .ARTICLE XIV. It is agreed that the sum of five hundred dollars annually, for three years from date, shall be expended in prei:;ents to the ten persons of said tribe who in the judgment of the agent, may grow the most valu-able crops for the respective year . .ARTICLE XV. The Indians herein named agree that when the agency house and other buildings shall be constructed on the reservation named, they will regard said reservation thdr permanent home, and they will make no permanent settlement elsewhere; but they shall have the right, sub-ject to the conditions and modifications of this treaty, to hunt, as stipulated in Article XI hereof. ARTIOLE XVI. The United States hereby agrees and stipulates that the country north of the North Platte river and east of the summits of the Big Horn mountains shall be held and considered to be unceded Indian territory, and also stipulates aud agrees that no white person or persons sha11 be permitted to settle upon or occupy any portion of the same; or without the consent of the Indians, first had and obtained, to pass tllrough the same; ancl it is further agreed by the United States, that within niuety days after the conclusion of peace with all the bands of the Sioux nation, the military posts now established in the territory in this article named shall be abandoned, and that the road leading to them and by them to the settlements in the Territory of Montana shall be closed. ARTICLE XVII. It is hereby expressly understood and agreed by and between the respective parties to this treaty that the execution of this treaty and its ratification by the United States Senate shall have the effect, and shall be construed as abrogating and annulling all treaties and agree-ments heretofore entered into between the respective parties hereto, so far as such treaties and agreements obligate tl.Ie U uited btates to fur-nish and provide money, clothing, or other articles of property to such Indians and bands of Indians as become parties to this treaty, but no further. In testimony of all which, we, the said comwissioners, and we, the chiefs and headmen of the Brule band of the Sioux nation, have here-unto set our bands and seals at Foft Laramie, Dakota Territory, this twenty-ninth day of April, in the year one thousand eight hundred and sixty-eight.
