One of the central features of South Africa\u27s transition from apartheid to a constitutional democracy was the establishment of a new Constitutional Court with the power first to approve the new Constitution and then to interpret and enforce its provisions, including the expansive Bill of Rights. Justice Richard J. Goldstone was appointed by President Nelson Mandela to the new Court and participated in many of its early decisions. He will discuss the complex issues involved in establishing a new apex court for post-apartheid South Africa with a particular focus on how it shaped a new democratic criminal justice system.
