Seed law in Argentina: vicissitudes of a reform that (still) was not

Desde 2003 existen intentos diversos por modificar la Ley de Semillas en Argentina, con la intención de brindarle mayor certidumbre a las empresas recortando derechos de los productores rurales. En el año 2012 esto tomó un nuevo impulso. Si bien no todos los actores involucrados en la temática participaron con la misma intensidad y legitimidad de la discusión, ésta se insertó (por lo menos en parte) en el espacio público. Sin embargo, el eje del debate estuvo centrado casi exclusivamente en un elemento: el denominado uso propio de las semillas, pero sólo en su articulación con el pago de regalías. Este artículo se centra en el análisis de los antecedentes que llevaron a la discusión actual; al tiempo que indaga en algunos nudos problemáticos de lo que la propiedad intelectual en semillas implica, con el fin de echar luz sobre algunos temas que estuvieron ausentes en el debate.There have been various attempts to modify the Seed Law in Argentina since 2003. The intention is to provide greater certainty to the companies by cutting the rights of rural producers. A new impulse, with the same orientation, occurred in 2012. Although not all the actors involved have participated with the same intensity and legitimacy on discussion, it was inserted (at least in part) in the public space. However, the debate`s axis was centered almost exclusively on a single element: the so-called own use of seeds, but only in its articulation with the royalties`s payments. This article focuses on the background that led to the current discussion; at the same time it analyzes some problematic knots of what the intellectual property in seeds implies, in order to shed light on some issues that were absent in the debate.Fil: Perelmuter, Tamara.
