ABSTRACT Sita Ulima Ekawati. NIM : S.351602042. ATTESTATION OF MARITAL AGREEMENT BY NOTARY ACCORDING TO CONSTITUTIONAL COURT’S VERDICT NUMBER 69/PUU-XIII/2015 WITH NOTARY LAW PERSPECTIVE. SEBELAS MARET UNIVERSITY NOTARIAL PROGRAM OF FACULTY OF LAW 2017. The purpose of this research is to observe and analyze the attestation of the marital agreement attested by Notary, according to the Constitutional Court’s verdict number 69/PUU-XIII/2015. This research used descriptive normative approach. This research also used primary data with legislation and official note, law making treatise, and judges’ verdict based on Islamic law, as its data collection method. This research used primary law material sourced from legislation. The result of this research shows that the attestation of marital agreement done by notary is done by making it in the form of authentic deed. It is regulated further in circular letter issued by Ministry of Religion number B.2674/DJ.III/KW.00/9/2017 and Department of Population and Civil Registration number 472.2/5876/Dukcapil about Marital Agreement Report Registration that the attestation referred in Constitutional Court’s verdict number 69/PUU-XIII/2015 is Notary attest the marital agreement by making it in the form of authentic deed, while the registration is done by the Marriage Registration Officer. The purpose of notary attestation on marital agreement in the form of Notarial Deed is as requirement for marriage registration mentioned in circular letter issued by Ministry of Religion number B.2674/DJ.III/KW.00/9/2017 and Civil Registration number 472.2/5876/Dukcapil regarding Marital Agreement Report Registration. The marital agreement must be registered to fulfill the publicity constituent so that the third party knows and obey the regulation made in the marital agreement by the marrying couple.
