SURAT TANDA BUKTI SEBAGAI AHLI WARIS DALAM PELAKSANAAN PENDAFTARAN PERALIHAN HAK ATAS TANAH BERDASARKAN PEWARISAN DARI AHLI WARIS BEDA GOLONGAN

The research of this research is to know and to analyze the implementation of registration of land rights transfer based on inheritance from different heirs class in the land office of Surakarta. This research also aims to know and analyze about how the execution of making the proof as heirs based on inheritance. This research uses empirical juridical and analytical descriptive research, the data source used is primary data and secondary data covering primary law material of secondary law material and tertiary law material. Data Analysis Technique using data analysis done qualitatively. The research resulted in the conclusion, that the certificate of evidence as heir to the Land Office of the City of Surakarta from the heirs of different groups proposed by the heirs themselves and their proxies is to see from the name of the right holder listed in the land certificate as well as in the Identity Card. The benchmark of a name in the land office is difficult to guide. There is no explanation for the classification of population if there is ethnic mixing due to marriage. The pluralism of making a proof as an heir still based on racial and ethnic grouping is out of sync with hierarchical higher-order legislation in the order of legislation. Reorientation of land registration arrangement due to inheritance by Land Affairs Office is better to be done immediately, due to the nature of Regulation of the Minister of Agriculture / Head of BPN No. 3/1997 Article 111 (1) letter c number 4 is merely as an administrative guideline in the Land Office (BPN) to avoid any future dispute.
