PEREDARAN PONSEL PINTAR BERTEKNOLOGI 4G/LTE DI INDONESIA (KAJIAN DARI ASPEK HUKUM PIDANA DAN HUKUM PERLINDUNGAN KONSUMEN)

This study aims to find out whether the regulation of importing 4G/LTE smartphones in Indonesia, both in terms of legislation, punishment arrangements, and their implications based of the minister of industrial regulation number 65/M-IND/PER/7/2016 about terms and procedures for calculation of domestic components. This study includes in normative legal research. The study approach used in this research is the approach of legislation. Legal materials that were used are primary legal materials and secondary legal materials. The method of analysis of legal materials using the method of deduction. Based on the results of this study, regulations related on import provision of 4G/LTE smartphones, still not in line with the reality that exists in society, it indicated with 4G/LTE smartphones that do not meet the Domestic Contents Certification is still sold freely in the Indonesian market . This study also explains causes why 4G/LTE smartphones that not pass the domestic components regulation still circulating in the Indonesian market
