New social movements are occupying the public space. They are watching the preservation of human rights and are reinventing politics. The article is a contribution for the discussion of the state of exception and the subjectivity of the exercise of citizenship as a praxis to defend social human rights. Inspired by Luís Alberto Warat, the text treats the problem within a critical view of law based on the psychoanalytical theory of Sigmund Freud and Jacques Lacan.
