PARADOXOS DECORRENTES DA INTERPRETAÇÃO DO ESTATUTO DA PESSOA COM DEFICIÊNCIA SOBRE A CAPACIDADE CIVIL

The article aims at to discuss the theme about the civil disability, starting from the problem: what structural and functional changes occurred with the disabilities theory with the enactment of Law nº. 13.146, published on July 7.2015, the Brazilian Disability Rights Law? Therefore, the question is if tutelage brought by the legislative standard (dignity, freedom) protects people with disabilities or whether modifications must be condemned, since the dignity of such persons should be protected by the binomial: dignity-vulnerability. The methodology consisted of theoretical and bibliographical research, with descriptive research and qualitative approach.O artigo tem por finalidade adentrar na temática da incapacidade civil partindo-se da problemática: quais as mudanças estruturais e funcionais sofridas pela teoria das incapacidades com o advento da Lei nº 13.146, publicada em 07 de julho de 2015, o Estatuto da Pessoa com Deficiência? Para tanto, questiona-se se a tutela trazida pela norma legislativa (dignidade-liberdade) protege as pessoas com deficiência ou se as modificações devem ser condenadas, uma vez que a dignidade de tais pessoas deveria ser resguardada pelo binômio: dignidade-vulnerabilidade.
