A Intervenção do Poder Judiciário na Elaboração e Execução das Políticas Públicas no Brasil

The present study aims to discuss the aspects of the intervention of the Judiciary for the enforcement of public policies, developed by Legislative and Executive powers, with aims to accomplish the fundamental rights provided for in the Federal Constitution of 1988. The objective is to find out if there is legitimacy for the jurisdiction to control the actions of the other powers in order to give maximum effectiveness to constitutional requirements, particularly, when there is a violation of those determinations concerned with fundamental rights, since the possibility of such a measure is admitted by thought neoconstitucionalism, not violating the principles of the Democratic State of Law.O presente estudo visa debater os aspectos da intervenção do Poder Judiciário para a efetivação das politicas públicas, desenvolvidas pelos Poderes Legislativo e Executivo, com vistas a efetivar os direitos fundamentais previstos na Constituição Federal de 1988. O objetivo é descobrir se há legitimidade para a jurisdição controlar as ações dos outros poderes instituídos no intuito de dar máxima efetividade às normas constitucionais, sobremaneira, quando ocorre a violação daquelas determinações que tratem de direitos fundamentais, uma vez que a possibilidade de tal medida é admitida pelo pensamento neoconstitucionalista não violando então os princípios do Estado Democrático de Direito
